SCOPE The Wisconsin Department of Transportation (WisDOT or DOT), through its Purchasing Unit (Purchasing), requests bids to establish a contract for the purchase of Low Doppler Radar Units. The attached Standard Terms and Conditions shall govern this bid unless specifically modified in the Special Conditions of Bid. Conditions of bid that include the word "must" or "shall,” describe a mandatory requirement. All specifications are defined as mandatory minimum requirements unless otherwise stated. If no bidder is able to comply with the given specifications or conditions of bid, Purchasing reserves the right to delete that specification or condition of bid. Failure to meet a mandatory requirement shall disqualify your bid. Questions regarding this bid must be submitted in writing via email to the following: Mark Tschanz, e-mail:

2.
CONTRACT TERM The contract term for this bid shall be for a period of one (1) year after date of award, with 3 one-year renewal options. WisDOT reserves the right to extend beyond the contract period if deemed to be in the best interest of WisDOT. Under mutual agreement, this Contract shall automatically be extended into its 2nd and 3rd years unless Purchasing is notified, in writing, by the Contractor 60 calendar days prior to expiration of the initial and/or succeeding Contract period(s).
3.
CONTRACT QUANTITIES/NEW OR DELETED ITEMS The estimated annual quantities identified for each item on the “BID PRICE SHEET” are for bid purposes only and are based on historical data. WisDOT does not guarantee to purchase any specific quantity. Bids that state WisDOT must guarantee a specific quantity or dollar amount may be disqualified.
NEW OR DELETED ITEMS: WisDOT reserves the right to add new products to this contract based on technology changes or changes to standards unknown at the time of this bid. Contractor(s) prices must be comparable to current contract pricing for like products. Contractor should promptly notify Purchasing of new or discontinued products.

CONTRACT REQUIREMENTS AND BIDDER/CONTRACTOR QUALIFICATIONS To be eligible for a contract award, you must be qualified and able to provide the following. Respond on attached "Bidder Response Sheet", “Vendor Information Sheet”, and “References Sheet”. 4.1 Bidder must be an original manufacturer, or distributor and/or dealer authorized by manufacturer. 4.2 Bidder must supply references of (3) firms to which similar products have been provided during the past three (3) years to a comparable sized institution or company. If contacted, all of those references must verify that a high level of satisfaction was provided. Use Attachment B to list references. 4.3 Bidder must be in the business of selling this type of device for the past (3) years. 4.4 Contractor must be able to report on a semi-annual basis all products purchased against this Contract, if requested. 4.5 Bidder must provide a statement of their Warranty Policy on any service or parts they may provide.
5.
SPECIFICATIONS See SPECIFICATIONS documents in ATTACHMENT F and the BID PRICE SHEET for the minimum acceptable specifications for products desired. Failure to provide product specifications and information shall disqualify your bid. WisDOT shall be the sole judge of equivalency and acceptability. Bid specifications may not be revised without an official written addendum issued by Purchasing.
6.
DELIVERY Delivery is desired as soon as possible after receipt of a purchase order. Please indicate on the Bid Cover Page your estimated delivery time in calendar days.
7.
F.O.B. DESTINATION FREIGHT INCLUDED Delivery will be made by common carrier or bidder's truck, with unloading to be performed by the carrier/bidder and carton(s) transported to the interior/ground floor or inside dock at various locations Statewide. Bid prices should include all packing, transportation, insurance charges and installation/operation manuals. Failure to bid FOB Destination Freight Included and Installed may disqualify your bid.
8.
METHOD OF BID Bidder must submit a unit price and extended total for each item. All prices must be quoted in U.S. Dollars. In the case mathematical errors occur on the bid price sheet, the indicated unit price shall prevail.

Bids requiring an order minimum shall be disqualified. Bidder must bid on the enclosed bid price sheet.
9.

Failure to provide the requested forms/information with your bid submittal may disqualify your bid. Bids may not be submitted via facsimile Because of increased building security, access to the WisDOT Purchasing Office is restricted and may cause delay if hand delivering your bid. Allow ample time for security clearance to room 751.
10.
SAMPLES / DEMONSTRATIONS Bidders may be required to submit samples for testing or as a control against product delivered. Samples requested upon request after bids are open must be delivered to the designated location within the time specified. WisDOT shall evaluate all samples requested in an identical manner to determine whether the products delivered conform to the specifications. WisDOT shall reject samples NOT meeting bid specifications. The bidder shall be notified in writing by WisDOT to pick up rejected samples, at the bidders expense, within 15 working days of date of such notification. Any rejected samples not picked up in the designated time period shall be disposed of as WisDOT sees fit. Failure to deliver samples within time designated may disqualify your bid.
11.
METHOD OF AWARD Award(s) shall be made on the basis of the lowest net unit price per item from a responsive, responsible bidder who meets specifications. The right is reserved, however, to make an award on the lowest total extended price per item whichever is judged to be in the best interest of WisDOT. Timeliness of delivery may be considered when making this award. 11.1
Volume discounts shall not be considered when determining award. However, they shall apply to orders issued on this contract.

MINORITY BUSINESS PARTICIPATION The Wisconsin Department of Transportation is committed to the promotion of minority businesses in the State’s purchasing program. Authority for this program is found in Wisconsin Statutes 15.107(2), 16.75(3m), and 16.755. Bidders are strongly urged to use due diligence to further this policy by setting up subcontracts to statecertified Minority Business Enterprises (MBE) and/or by using such enterprises to provide goods and services incidental to this contract (second-tier suppliers), with a goal of awarding 5% of the contract cost to such enterprises. An MBE means a business certified, or certifiable, by the Wisconsin Department of Commerce under Statute 560.036(2). Bidders must submit the attached WisDOT MBE Program Awareness, Compliance & Action Plan (Attachment C) indicating their proposed utilization of state-certified minority businesses for this contract. Contact the State’s Minority Business Director for assistance in locating certified firms at (608) 267-7806 or the WisDOT Minority Business Program Specialist at 608-267-2886. A listing of State of Wisconsin certified minority businesses, as well as the services and commodities they provide, is on the State-certified MBE web site: http://www.doa.state.wi.us/deo/mbe/minority_search.asp Quarterly reports, as agreed, (Attachment D) are requested to be submitted to the Department of Transportation, Purchasing Unit, itemizing the deliveries and cost of items or services provided by certified firms. Reports should state the costs for the previous contract quarter. The department reserves the right to verify with listed firms their involvement as subcontractors or second-tier suppliers.
13.
SUBCONTRACTING OR THIRD PARTY PAYMENTS All subcontracting shall be pre-approved by WisDOT. Subcontractors must abide by all terms and conditions of the contract. The prime contractor shall be responsible for all subcontractor(s) work and payment. The WisDOT will not pay any subcontractor or third parties directly.
14.
FIRM PRICES Prices must remain firm for 180 calendar days after bid opening. Prices established may be lowered due to general market conditions. Price change requests must be received by Purchasing in writing 60 calendar days prior to the effective date of proposed increase for acceptance or rejection. Proposed price increases are limited to fully documented cost increases submitted with the request. If Purchasing deems cost increases are not acceptable, it reserves the right to re-bid the contract in whole or part. Acceptance of the price increases shall be in writing.
15.
ORDERS WisDOT may use the following methods to purchase from this contract: Specific (Contract Release) orders may be placed for one-time shipments. Contract Release Orders, blanket-type, may be issued by Purchasing for the State’s fiscal year time period, July 1 – June 30, to allow departmental personnel to call or fax for product or service against the order as needed. Purchasing card releases: placed by department personnel using their State purchasing card under WisDOT and State guidelines.

INVOICING REQUIREMENTS Invoices/Purchase Order: WisDOT must meet a statutory mandate to pay or reject invoices within 30 days of receipt by WISDOT. Before payment is made, it also must verify that all invoiced charges are correct as per this contract. Only properly submitted invoices shall be officially received for payment. Thus, your prompt payment requires that your invoices be clear and complete in conformity with the instructions below.

The original invoice and two copies must be sent to the bill-to address shown on the Purchase Order. Invoices/Purchasing card Orders placed by WisDOT using a purchasing card must reflect current contract pricing.
17.
ITEM RETURN POLICY Contractor must provide for return of products ordered in error for up to 30 calendar days from receipt without a restocking charge and WisDOT paying only the return shipping costs. Any defective products received will be returned with the Contractor bearing the cost of return shipping. Indicate in detail on the Bidder Response Sheet your return policy.
18.
SHIPMENTS, DUPLICATES AND OVER SHIPMENTS Upon notification by WisDOT of a duplicate or over shipment, product must be removed at the contractor's expense. If such goods are not removed within 30 days of written notification, WisDOT reserves the right to dispose of them as its own property and shall not be held liable for the cost.
19.
CONTRACT CANCELLATION This Contract may be terminated by either party under the following conditions: 19.1
Please review section 13.0 and 24.0 of the Standard terms and Conditions of Bid. WisDOT may terminate the contract at any time at its sole discretion by delivering 30 days written notice to the contractor. Upon termination, WisDOT’s liability will be limited to the pro rata cost of the services performed as of the date of termination.
19.2
In the event the contractor terminates the contract, for any reason whatsoever, it will require written certified letter notification delivered to the Department purchasing agent not less than 60 days prior to said termination. The contractor will, in turn, refund the Department, within 30 days of said termination, all payments made hereunder by the Department to the contractor for work not completed.

19.3
If at any time the contractor performance threatens the health and/or safety of WisDOT, WisDOT has the right to cancel and terminate the Contract without notice.
19.4
Failure to maintain the required Certificates of Insurance, Permits, or Licenses shall be cause for contract termination. If the Contractor fails to maintain and keep in force the insurance as provided in #23.0 of the Standard Terms and Conditions, WisDOT has the right to cancel and terminate the Contract without notice.
19.5
If at any time a petition in bankruptcy shall be filed against the contractor and such petition is not dismissed within 90 calendar days, or if a receiver or trustee of contractor's property is appointed and such appointment is not vacated within 90 calendar days, WisDOT has the right, in addition to any other rights of whatsoever nature that it may have at law or inequity, to terminate this Contract by giving 90 calendar days notice in writing of such termination.
CERTIFICATION FOR COLLECTION OF SALES AND USE TAX The State of Wisconsin shall not enter into a contract with a vendor, and reserves the right to cancel any existing contract, if the vendor or contractor has not met or complied with the requirements of s.77.66, Wis. Stats., and related statutes regarding certification for collection of sales and use tax.

WisDOT MINORITY BUSINESS ENTERPRISE (MBE) PROGRAM AWARENESS, COMPLIANCE & ACTION PLAN As a matter of sound business practice, the Wisconsin Department of Transportation is committed to “supply diversity” by promoting the use of minority business whenever and wherever possible. Further, as an agency of the State of Wisconsin, WisDOT shares in the state goal of placing five (5) percent of its total annual purchasing dollars with state-certified minority businesses. ATTACHMENT F SPECIFICATIONS FOR TRAFFIC RADAR, MODIFIED FOR USE AS SPEEDMETER WITH SINGLE ANTENNA AND REMOTE DISPLAY A. Purpose The purpose of the specifications is to establish a minimum standard of quality for radar units to be used for this department’s traffic Speedmeter program. B. Scope These specifications cover a Doppler radar designed to measure, compute and display the Low Doppler (Ground Speed) signal reflected from an area 100 to 150 feet from the moving patrol car known as the “hot spot”. C. Regulatory Approval 1. All radar units bid shall have type acceptance approval pursuant to Part 90 of the Federal Communications Commission (FCC) Rules and Regulations. 2. The pre-modified unit shall conform to the National Highway Traffic Safety Administration (NHTSA) “Model Minimum Performance Specifications for Police Traffic Radar Devices”, and shall be on the latest published Consumer Products List (CPL) of the International Association of the Chiefs of Police (IACP). Copies of the FCC and CPL approvals shall be included with the bid. The unit shall operate within a frequency range of 33.6 to 36.0 Ghz. (Ka-Band) D. Sample and Demonstration If requested, the bidder shall furnish a complete sample unit for examination and testing. E. Radar Bid Requirements 1. Production Model The pre-modified radar device shall have been in full commercial production. No “brand new” or prototype models will be considered for purchase. 2. Performance Testing and Product Evaluation The radar may be field-tested and laboratory tested to verify its acceptance level of performance and conformity to specifications. Emphasis will be placed on the radar unit’s ability to maintain a stable reading without displaying false readings while subject to induced interferences from the following sources: a. High-powered television stations b. UHF, VHF, and HF transmitters c. Automobile alternator, ignition and electrical systems d. Automobile heater and air conditioner fan motor e. High voltage power lines, traffic signals, neon signs, etc. f. Laptop computers in the police car, including when the computer is communicating via wireless transmitter This agency also reserves the right to have radar units examined by any other qualified agency for acceptable design, construction, fabrication, and assembly methods. 3. Certification All radar units furnished under any resulting contract shall be factory certified as to accuracy with test procedures and equipment that conform to the National Bureau of Standards and Technology.

F. System Description 1. The radar set shall consist of the following items: a. Antenna b. Antenna cable with a minimum length of 8 feet. A 1-foot long piece of hard but pliable rubber material for placing over the cable to protect it when the door is closed on the cable. c. Antenna mounting bracket including required hardware to fasten the antenna securely to the bracket. The bracket shall be a window-style that is placed over the glass and is secured when the window is rolled up and further secured by at least 2 suction cups pressed onto the glass. d. Counting unit with cigarette-style power plug e. Remote display f. Remote display cable with a minimum length of 4 feet g. Two tuning forks with a soft protective cover included h. Operators manual i. Carrying Case. G. Performance Requirements 1. The radar shall operate within a frequency range of 33.6 to 36.0 Ghz. 2. The system shall operate from the unfiltered power supply available in a standard automotive vehicle. Current drain on the vehicles electrical system shall not exceed 1.5 amps. 3. The radar shall be accurate throughout its range within plus or minus 1 MPH. The radar shall truncate (round down) the display MPH to a whole number. 4. The radar shall be able to obtain a ground speed (Low Doppler) signal and lock onto that signal utilizing a series of filters and tracking circuits. The radar shall not process the strongest signal, but shall start at the lower limit of the ground speed filter and begin tracking from that point. 5. The radar shall operate normally over the complete range of the factory specified temperatures as established by the manufacturer and generally accepted as an industry standard. H. Antenna 1. The antenna beam width shall not exceed 13 Degrees, nor be less than 11 Degrees. 2. The antenna cable shall have a removable locking connector at both ends for ease of repair and installation. The connector at the antenna shall be designed to easily accept the antenna cable without placing undue stress or causing damage to the electrical pins. 3. The antenna shall be the smallest size Ka-Band type available from the vendor. 4. The antenna bracket shall be a window mount. 5. Under no circumstances shall the radar unit transmit an RF microwave radiation power level in excess of 50 mW, with output of 10 to 12 mW typical preferred. I. Counting Unit with Remote Display 1. The radar shall have only one (1) active speed display window, which is the one for the Patrol Speed indication. All other display windows shall be non-operational with no display indicated. 2. The radar shall have the range set at maximum with no operator adjustable input allowed. 3. The remote display shall be the smallest size available from the vendor. 4. The counting unit shall have no audio. 5. The counting unit power cable shall be a minimum of 4 feet long, and shall have a heavy-duty male connector plug compatible with a conventional cigarette-lighter receptacle of a vehicle. The plug shall be internally fused with a quick-change 12 volt, 2 amp SLO-BLO standard glass fuse. 6. The counting unit or remote display shall have an identification label that gives the following minimum information: a. Manufacturers name and address b. Radar unit serial number c. Manufacturers model number and/or part number 7. The counting unit shall be equipped with a low voltage warning indicator. If the power falls below 10.8 VDC, the counting unit shall visually indicate a low voltage condition and not permit any speed readings to be displayed. 8. The counting unit shall have a manual internal calibration check function. This includes a visual display of this function that clearly indicates a pass or fail of this check. 9. The counting unit shall be equipped with a visual indicator that shows when the unit is transmitting a signal.

10. The counting unit shall be equipped with a visual indicator that shows when a self-test has been initiated. Should this test fail, the unit shall illuminate the crystal error indicator. 11. The counting unit shall be equipped with a visual indicator that shows when excessive extraneous radio frequency fields are present, and no readings shall be displayed while this condition exists. 12. The counting unit shall have reverse polarity protection so that no damage will result due to reversal of power supply. 13. The radar shall have a speed range from 15 mph to 100 mph.
J. Tuning Forks 1. The radar shall come with two (2) tuning forks. These forks shall be of the manufacturer suggested speed inputs so as to make the radar process and display known speeds in both the stationary and moving modes. The tuning forks shall have a factory specified accuracy of plus or minus 1 mph. 2. The tuning forks shall come with a soft protective cover for each fork. 3. The tuning forks shall be stamped with the type of fork (K-Band), the serial number, and the speed. L. Additional Required Items 1. Three (3) complete set of operating instructions including case law history in the use of traffic radar speed devices, theory and operation, and trouble shooting information shall be furnished by the vendor with each radar device. 2. The vendor shall provide technical expertise and documentation including, but not limited to, the engineering principles, scientific theory and reliability, and the overall accuracy of the radar speed device for court purposes. 3. For every five (5) radar sets ordered, the vendor shall furnish one (1) additional antenna cable. M. Warranty Provide warranty information for all parts, assemblies, and components of the radar speed device. Written proof of the warranty by the manufacturer must be furnished by the bidder and attached to the bid. The warranty shall include a full guarantee from the manufacturer that each radar speed device shall be free from defects in materials and workmanship from a period commencing with the date the radar device is placed into service by the agency, and ending after a period of three (3) years has elapsed. The manufacturer shall provide any and all software changes developed and implemented during the warranty period at no expense to the agency. All shipping charges from the agency to the manufacturer and from the manufacturer to the agency shall be at the sole expense of the manufacturer during the warranty period.
