Product description The IBM High Rate Wireless LAN (PCI) Card is a standard PCI card that fits into any standard PCI slot. It has one light-emitting diode (LED) indicator and an external antenna. This PCI card is used to create a wireless network that complies with the IEEE 802.11b standard on wireless LANs. It supports data-transfer rates up to 11 Mbps. This PCI card is fully compatible with any other wireless LAN system based on direct sequence spread spectrum (DSSS) radio technology that complies with the IEEE 802.11b standard on wireless LANs. The card supports the following wireless LAN features: v Automatic Transmit Rate select mechanism in the range of high, medium, standard, and low v Frequency channel selection (2.4 GHz) v Roaming over multiple channels v Card Power Management v Wired Equivalent Privacy (WEP) data encryption, based on the 64-bit and 128-bit WEP encryption algorithm as defined in the IEEE 802.11 standard on wireless LANs In addition to this manual, your package contains the following: v IBM High Rate Wireless LAN (PCI) Card v The IBM Driver and Utility CD v IBM High Rate Wireless LAN (PCI) Card Quick Installation Guide If any of these items are missing or damaged, contact your reseller. The PCI card is a standard PCI bus card that you can use to install the IBM High Rate Wireless LAN (PCI) Card into a computer. © Copyright IBM Corp. 2001 1-1 Installing the device drivers and software Your computer must meet the following requirements to work with the IBM High Rate Wireless LAN (PCI) card: v PCI specification compliant PCI slot v Microsoft® Windows® 95, Windows 98, Microsoft Windows 2000 Professional, Windows Millennium Edition (Me) or Windows NT operating system (Service Pack 6 or higher) v A minimum of 5 MB of free disk space for the driver and utility program Installing the IBM High Rate Wireless LAN (PCI) Card To install the PCI card into your computer, carefully follow these steps: 1. Shut down your computer. 2. Disconnect the power cords from your computer and all external devices that are connected to your computer. 3. Remove the top or side cover of your computer, according to the instructions in the user’s guide that came with your computer. 4. Select an available PCI slot for the card, and remove the metal filler strip. Keep the screw for mounting the card. 5. Make sure that you remove the antenna from the card, and gently insert the connector of the PCI card into the slot. 6. Secure the card into place with the screw that you removed in step 4. 1-2 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 7. Install the antenna, see “Installing and removing the antenna” on page 1-3 for more information. 8. Replace the computer cover according to the instructions in the user’s guide that came with your computer. 9. Reconnect all the external devices and power cords to your computer. 10. Turn on your computer to complete the hardware installation. Installing and removing the antenna There are two types of antennas that could be used with this Wireless LAN (PCI) Card: v Helical antenna is for the IBM NetVista™ X41 computer v Dipole antenna is for other IBM or non IBM computers CAUTION: Make sure the computer is off when you install or remove the antenna. Installing or removing the antenna while the computer is on might cause injury or might damage the PCI card. Never operate the High Rate Wireless LAN (PCI) Card without the antenna installed. Installation and User’s Guide 1-3 Installing and removing the antenna 1. Make sure that the computer is turned off. 2. Insert one end of the antenna into the antenna connector labeled ANT. 3. Install the antenna by threading it counterclockwise until it is firmly seated. Do not overtighten. 1-4 IBM High Rate Wireless LAN (PCI) Card: User’s Guide To remove the antenna, reverse the above procedure. Installing device drivers Make sure that you have completed hardware installation before you turn on your computer and start installing the device drivers and software. Installing the device drivers for Windows 95 Use this procedure to install the device drivers and software: Notes: v Do not install hardware first. v Windows 95 OSR2 or higher is required for the IBM High Rate Wireless LAN (PCI) Card. v This software is intended only for Windows 95 OSR2 or higher. v Follow instructions below. Downloading device drivers and software. 1. Visit the IBM PC Support web page at http://www.ibm.com/support. 2. Download the file ″LP-PCIWin95Only.exe″ for IBM High Rate Wireless LAN (PCI) Card. Extracting the device drivers and software. 3. Execute the self-extracting zip file ″LP-PCIWin95Only.exe″ by double-clicking on the icon. Installation and User’s Guide 1-5 4. Extract the files to the default folder or a folder of your choice. 5. Select Finish to extract and copy the files to the specified location. Select the option which allows you to create the folder if it does not already exist. 6. Click OK to complete extraction. Installing the device drivers and software Note: Do not install hardware first. 1. Execute setup.exe located in the ″\setup″ directory under the path where the files were extracted. 2. Refer to “Installing the IBM Wireless LAN Client Manager” on page 1-31. 3. Shutdown your computer. 4. Install the hardware. Refer to “Installing the IBM High Rate Wireless LAN (PCI) Card” on page 1-2. 5. Windows 95 will automatically install drivers for the new device. 6. Installation is complete. Installing the device drivers for Windows 98 Use this procedure to install the device drivers: 1. Windows will automatically find the IBM High Rate Wireless LAN (PCI) after the card has been physically installed. 2. Insert the IBM Driver & Utility CD in the CD-ROM drive. 3. Click Next. 4. Choose ″Search for the best driver for your device”. 1-6 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 5. Click Next. 6. Select Specify a location. 7. Input the location of the driver. The location is the drive in which the CD was inserted with a directory path of ″\Driver″. See example in figure below. 8. Windows will find the following file for device driver installation. Installation and User’s Guide 1-7 9. Click Next. 10. Enter any specific wireless network information in the utility page to setup your wireless card. 11. Click OK when finished. 1-8 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Note: These settings can be changed at a later time, as described on page 1-31 through 1-35. 12. Windows will require the original Windows CD-ROM to complete driver installation. Please remove the IBM Driver & Utility CD and insert the Windows disc to complete installation. Note: Windows may have difficulty finding the appropriate files. If so, ensure that the path to the CD-ROM drive is correct with a path of \WIN98 or Installation and User’s Guide 1-9 \WIN95 dependent upon your operating system. Click OK. 13. Click Finish to complete the installation procedure. 14. Select Yes to restart your computer. Installing the device drivers for Windows Me To install the device drivers for Microsoft Windows Millennium Edition (Me), do the following: 1-10 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 1. Windows will automatically find the IBM High Rate Wireless LAN (PCI) after the card has been physically installed. 2. Insert the IBM Driver & Utility CD into the CD-ROM drive. 3. Select Automatic search for a better driver. 4. Click Next. 5. Enter any specific wireless network information in the utility page to set up your wireless card. 6. Click OK. Installation and User’s Guide 1-11 Note: These settings can be changed at a later time, as described on page 1-31 through 1-35. 7. Click Finish to complete the installation procedure. 1-12 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 8. Click Yes to restart your computer. Installing the device drivers in Windows NT with networking already installed Use this procedure to install the device drivers in a computer running Windows NT 4.0 with networking already installed: 1. Click Start → Settings → Control Panel. 2. Double-click the Network icon. Note: If Windows NT Networking is not installed on your computer, the following window will be shown. Please consult your network administrator for further information on installing Windows NT Installation and User’s Guide 1-13 Networking. 3. Click the Adapters tab. 4. 1-14 Click Add to add a new adapter. IBM High Rate Wireless LAN (PCI) Card: User’s Guide 5. Click Have Disk. 6. Input the location of the driver. The location is the drive in which the CD was inserted with a directory path of ″\Driver.″ See example in figure below. 7. Click OK. 8. Select IBM High Rate Wireless LAN (PCI) Card. Installation and User’s Guide 1-15 9. Click OK. 10. Enter any specific wireless network information in the utility page to set up your wireless card. 11. Click Next. Note: These settings can be changed at a later time, as described on page 1-31 through 1-35. 12. If your wireless network requires encryption (WEP), modify the encryption settings to meet network requirements as described on page 1-35 through 1-38. 13. Click Finish. 1-16 IBM High Rate Wireless LAN (PCI) Card: User’s Guide For additional information, contact your network administrator. 14. In the list of adapters, the IBM High Rate Wireless LAN PCI Card will be displayed. 15. Click Close to complete the installation. Installation and User’s Guide 1-17 16. If you have a DHCP server on your network, select ″Obtain an IP address from a DHCP server″. Otherwise, you may manually input IP information. For further information, contact your network administrator or Internet Service Provider (ISP). 17. Click OK. 18. Click Yes to restart your computer to complete the installation procedure. Installing the device drivers in Windows 2000 Use this procedure to install the device drivers in a computer running Windows 2000: 1-18 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 1. Windows will automatically find the IBM High Rate Wireless LAN (PCI) after the card has been physically installed. 2. Insert the IBM Driver & Utility CD into the CD-ROM drive. 3. Click Next. 4. Select ″Search for a suitable driver for my device″. 5. Click Next. 6. Verify that the ″CD-ROM drives″ check box is selected. Installation and User’s Guide 1-19 7. Click Next. 8. Windows will find the following file for the device driver installation. 9. Click Next. 10. Enter any specific wireless network information in the utility page to set up your wireless card and click Next. 1-20 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Note: These settings can be changed at a later time, as described on page 1-31 through 1-35. 11. If your wireless network requires encryption (WEP), modify the encryption settings to meet network requirements as described on page 1-35 through 1-38. 12. Click Next. 13. Setting up TCP-IP for Windows 95, Windows 98, or Windows Me To set up TCP-IP for Windows 95, Windows 98, or Windows Me, do the following: 1. Select TCP/IP->IBM 802.11 Wireless LAN PCI Card. Installation and User’s Guide 1-23 4. Click Properties. 5. If you have a DHCP server on your network, select ″Obtain an IP address automatically″. Otherwise, you may manually input IP information. For further information, contact your network administrator or Internet Service Provider (ISP). 1-24 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 6. Click OK to finish. Setting up TCP-IP in Windows NT To set up TCP-IP in Windows NT, do the following: 1. From the Start button, go to Start->Settings->Control Panel. Installation and User’s Guide 1-25 2. Double-click Network. 3. Select Protocols. 4. Select TCP/IP Protocol. 1-26 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 5. Click Properties. 6. In the Adapter section, select the IBM High Rate Wireless LAN PCI Card. 7. If you have a DHCP server on your network, select ″Obtain an IP address from a DHCP server″. Otherwise, you may manually input IP information. For further information, contact your network administrator or Internet Service Provider (ISP). 8. Click OK to finish. Installation and User’s Guide 1-27 Setting TCP-IP in Windows 2000 To set up TCP-IP in Windows 2000, do the following: 1. Using the right mouse button, click Local Area Connection that refers to the wireless network. 4. Select Properties. 5. Select Internet Protocol (TCP/IP). Installation and User’s Guide 1-29 6. Click Properties. 7. If you have a DHCP server on your network, select ″Obtain an IP address automatically″. Otherwise, you may manually input IP information. For further information, contact your network administrator or Internet Service Provider (ISP). 1-30 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 8. Click OK to finish. Installing the IBM Wireless LAN Client Manager After the device drivers are installed and the computer is restarted, use this procedure to install the IBM Wireless LAN Client Manager: 1. Insert the IBM Driver and Utility CD into the CD-ROM drive. 2. If the CD does not start automatically, consult the CD label for instructions. 3. Select Install IBM Wireless LAN Client Manager. Installation and User’s Guide 1-31 4. Click Next. 5. Select the Program Folder in which the shortcut must be installed. 6. Click Next. 7. Select Yes, I want to restart my computer now. 1-32 IBM High Rate Wireless LAN (PCI) Card: User’s Guide 8. Click Finish to complete installation procedure. Using the IBM Wireless LAN Client Manager The functions of the IBM Wireless LAN Client manager are on four pages: 1. Configuration 2. Encryption 3. Link 4. About The following sections describe these functions. Configuration This section describes the settings on the Configuration page. Profile If you are going to use the Wireless LAN (PCI) Card in multiple networking environments that require different configuration settings, you can define a dedicated profile for each environment. For example, you can create one profile for your office and another for your home office. Each profile has a profile name and contains the network name, network type, communication channel, communication data rate, power-management setting and any encryption keys for the environment. The initial configuration is stored in the default profile. Installation and User’s Guide 1-33 When you move your computer from one environment to another, you can quickly change the Wireless LAN (PCI) Card settings by selecting the profile for the new environment. To create a new profile, simply type the name that you would like for the profile and make the appropriate selections in the IBM Wireless LAN Client Manager window. Mode You can select between two modes: v Infrastructure - An infrastructure network consists of wireless workstations that are interconnected through one access point or through multiple access 1-34 IBM High Rate Wireless LAN (PCI) Card: User’s Guide points and a wireless backbone. v 802.11 AdHoc - An AdHoc network consists of workstations within mutual communication range of each other through the wireless medium. SSID To join your computer to an existing network that includes access points or to set up an AdHoc network, select or type the network name in the SSID field. If the Wireless LAN (PCI) Card is operating in Infrastructure mode, use the infrastructure network name, or if you want the Wireless LAN (PCI) Card to connect any IEEE 802.11 infrastructure network it can find, use the name ANY Installation and User’s Guide 1-35 (all capital letters). Transmit Rate Select a transmission rate: v Auto 1 or 2 Mb v 5.5 Mb v 11 Mb v Fully Automatic Note: Fully Automatic selects the transmission rate that is optimal for the network environment. 1-36 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Power Save Enabled To enable power management, select the Power Save Enabled check box. AdHoc Channel The AdHoc Channel field is available only if you have selected 802.11 AdHoc in the Mode field. Select a channel number from 1 to 14. In some countries, only 11 channels might be available. Installation and User’s Guide 1-37 Encryption This section describes the settings on the Encryption page. Encryption (WEP) Select Disabled to disable encryption. Select 64 bit or 128 bit to enable encryption. Create Key with Passphrase This window allows you to enter a generic phrase consisting of any characters that takes the pass phrase and generate random keys automatically for you. 1-38 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Create Key Manually If you have enabled encryption and select this option, specify up to four different keys to decrypt data that is received by your computer through the wireless network. The keys must be hexadecimal values. If you have selected 64-bit encryption, specify 10-digit hexadecimal values (for example, ABCD123456). If you have selected 128-bit encryption, specify 26-digit hexadecimal values (for example, ABCD123456ABCD123456987654). The only valid character entries are 0-9 and A-F. Installation and User’s Guide 1-39 Default Key Select the key that is to be used to encrypt packets that will be transmitted from your computer. 1-40 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Link Status This section describes the settings on the Link page. State This field displays the current connect status of the computer. The status can be any of the following: v The current station is disabled v Searching for initial connection Installation and User’s Guide 1-41 v Associated (connected to a network) v Reassociation (a current association is being transferred from one access point to another) Current channel This field displays the number of the communication channel that is being used by the network to which the computer is connected. Current Tx Rate This field displays the data rate (in Mbits/sec) that is being used for data transmission. If the Wireless LAN (PCI) Card is operating in AdHoc mode, this field will not show the correct value, because the field displays the date rate only for the first frame. Throughput This field displays the throughput rate (in bytes per second) of transmitted (Tx) and received (Rx) data. Link Quality This field displays the quality communication in relation to the network to which the computer is connected. Signal strength This field displays the strength of the signal in relation to the network to which the computer is connected. 1-42 IBM High Rate Wireless LAN (PCI) Card: User’s Guide About This page displays the version and built date of each component of the IBM Wireless LAN Client Manager. Adjusting the antenna orientation to get better performance The default antenna orientation pointing straight up, generally provides the best signal strength and quality. Look at the icon tray and adjust the orientation of the antenna so that the optimal connection is achieved as described in “Understanding the IBM Wireless LAN Client Manager System tray icon”. A-2 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Part 1 - General Terms This Statement of Limited Warranty includes Part 1 - General Terms and Part 2 - Country-unique Terms. The terms of Part 2 replace or modify those of Part 1. The warranties provided by IBM in this Statement of Limited Warranty apply only to Machines you purchase for your use, and not for resale, from IBM or your reseller. The term “Machine” means an IBM machine, its features, conversions, upgrades, elements, or accessories, or any combination of them. The term “Machine” does not include any software programs, whether pre-loaded with the Machine, installed subsequently or otherwise. Unless IBM specifies otherwise, the following warranties apply only in the country where you acquire the Machine. Nothing in this Statement of Limited Warranty affects any statutory rights of consumers that cannot be waived or limited by contract. If you have any questions, contact IBM or your reseller. The IBM Warranty for Machines IBM warrants that each Machine 1) is free from defects in materials and workmanship and 2) conforms to IBM’s Official Published Specifications (“Specifications”). The warranty period for a Machine is a specified, fixed period commencing on its Date of Installation. The date on your sales receipt is the Date of Installation unless IBM or your reseller informs you otherwise. If a Machine does not function as warranted during the warranty period, and IBM or your reseller are unable to either 1) make it do so or 2) replace it with one that is at least functionally equivalent, you may return it to your place of purchase and your money will be refunded. Extent of Warranty The warranty does not cover the repair or exchange of a Machine resulting from misuse, accident, modification, unsuitable physical or operating environment, improper maintenance by you, or failure caused by a product for which IBM is not responsible. The warranty is voided by removal or alteration of Machine or parts identification labels. Items Not Covered by Warranty IBM does not warrant uninterrupted or error-free operation of a Machine. Any technical or other support provided for a Machine under warranty, such as assistance via telephone with “how-to” questions and those regarding Machine set-up and installation, will be provided WITHOUT WARRANTIES OF ANY KIND. Warranty Service To obtain warranty service for a Machine, contact IBM or your reseller. If you do not register your Machine with IBM, you may be required to present proof of purchase. During the warranty period, IBM or your reseller, if approved by IBM to provide warranty service, provides without charge certain types of repair and exchange service to keep Machines in, or restore them to, conformance with their Specifications. IBM or your reseller will inform you of the available types of service for a Machine based on its country of installation. At its discretion, IBM or your reseller will 1) either repair or exchange the failing Machine and 2) provide the service either at your location or a service center. IBM or your reseller will also manage and install selected engineering changes that apply to the Machine. Some parts of IBM Machines are designated as Customer Replaceable Units (called “CRUs”), e.g., keyboards, memory, or hard disk drives. IBM ships CRUs to you for replacement by you. You must return all defective CRUs to IBM within 30 days of your receipt of the replacement CRU. You are responsible for downloading designated Machine Code and Licensed Internal Code updates from an IBM Internet Web site or from other electronic media, and following the instructions that IBM provides. When warranty service involves the exchange of a Machine or part, the item IBM or your reseller replaces becomes its property and the replacement becomes yours. You represent that all removed items are genuine and unaltered. The replacement may not be new, but will be in good working order and at least functionally equivalent to the item replaced. The replacement assumes the warranty service status of the replaced item. Many features, conversions, or upgrades involve the removal of parts and their return to IBM. A part that replaces a removed part will assume the warranty service status of the removed part. A-4 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Before IBM or your reseller exchanges a Machine or part, you agree to remove all features, parts, options, alterations, and attachments not under warranty service. You also agree to 1. ensure that the Machine is free of any legal obligations or restrictions that prevent its exchange; 2. obtain authorization from the owner to have IBM or your reseller service a Machine that you do not own; and 3. where applicable, before service is provided: a. follow the problem determination, problem analysis, and service request procedures that IBM or your reseller provides; b. secure all programs, data, and funds contained in a Machine; c. provide IBM or your reseller with sufficient, free, and safe access to your facilities to permit them to fulfill their obligations; and d. inform IBM or your reseller of changes in a Machine’s location. IBM is responsible for loss of, or damage to, your Machine while it is 1) in IBM’s possession or 2) in transit in those cases where IBM is responsible for the transportation charges. Neither IBM nor your reseller is responsible for any of your confidential, proprietary or personal information contained in a Machine which you return to IBM or your reseller for any reason. You should remove all such information from the Machine prior to its return. Limitation of Liability Circumstances may arise where, because of a default on IBM’s part or other liability, you are entitled to recover damages from IBM. In each such instance, regardless of the basis on which you are entitled to claim damages from IBM (including fundamental breach, negligence, misrepresentation, or other contract or tort claim), except for any liability that cannot be waived or limited by applicable laws, IBM is liable for no more than 1. damages for bodily injury (including death) and damage to real property and tangible personal property; and 2. the amount of any other actual direct damages, up to the charges (if recurring, 12 months’ charges apply) for the Machine that is subject of the claim. For purposes of this item, the term “Machine” includes Machine Code and Licensed Internal Code. This limit also applies to IBM’s suppliers and your reseller. It is the maximum for which IBM, its suppliers, and your reseller are collectively responsible. UNDER NO CIRCUMSTANCES IS IBM LIABLE FOR ANY OF THE FOLLOWING: 1) THIRD-PARTY CLAIMS AGAINST YOU FOR DAMAGES Appendix A. Governing Law Both you and IBM consent to the application of the laws of the country in which you acquired the Machine to govern, interpret, and enforce all of your and IBM’s rights, duties, and obligations arising from, or relating in any manner to, the subject matter of this Agreement, without regard to conflict of law principles. Part 2 - Country-unique Terms AMERICAS BRAZIL Governing Law: The following is added after the first sentence: Any litigation arising from this Agreement will be settled exclusively by the court of Rio de Janeiro. NORTH AMERICA Warranty Service: The following is added to this Section: To obtain warranty service from IBM in Canada or the United States, call 1-800-IBM-SERV (426-7378). CANADA Governing Law: The following replaces “laws of the country in which you acquired the Machine” in the first sentence: laws in the Province of Ontario. UNITED STATES Governing Law: The following replaces “laws of the country in which you acquired the Machine” in the first sentence: laws of the State of New York. Limitation of Liability: The following is added to this Section: Where IBM is in breach of a condition or warranty implied by the Trade Practices Act 1974 or other similar legislation, IBM’s liability is limited to the repair or replacement of the goods or the supply of equivalent goods. Where that condition or warranty relates to right to sell, quiet possession or clear title, or the goods are of a kind ordinarily acquired for personal, domestic or household use or consumption, then none of the limitations in this paragraph apply. Governing Law: The following replaces “laws of the country in which you acquired the Machine” in the first sentence: laws of the State or Territory. CAMBODIA, LAOS, AND VIETNAM Governing Law: The following replaces “laws of the country in which you acquired the Machine” in the first sentence: laws of the State of New York. The following is added to this Section: Disputes and differences arising out of or in connection with this Agreement shall be finally settled by arbitration which shall be held in Singapore in accordance with the rules of the International Chamber of Commerce (ICC). The arbitrator or arbitrators designated in conformity with those rules shall have the power to rule on their own competence and on the validity of the Agreement to submit to arbitration. The arbitration award shall be final and binding for the parties without appeal and the arbitral award shall be in writing and set forth the findings of fact and the conclusions of law. All proceedings shall be conducted, including all documents presented in such proceedings, in the English language. The number of arbitrators shall be three, with each side to the dispute being entitled to appoint one arbitrator. The two arbitrators appointed by the parties shall appoint a third arbitrator before proceeding upon the reference. The third arbitrator shall act as chairman of the proceedings. Vacancies in the post of chairman shall be filled by the Appendix A. Product warranty and support information A-7 president of the ICC. Other vacancies shall be filled by the respective nominating party. Proceedings shall continue from the stage they were at when the vacancy occurred. If one of the parties refuses or otherwise fails to appoint an arbitrator within 30 days of the date the other party appoints its, the first appointed arbitrator shall be the sole arbitrator, provided that the arbitrator was validly and properly appointed. The English language version of this Agreement prevails over any other language version. HONG KONG AND MACAU Governing Law: The following replaces “laws of the country in which you acquired the Machine” in the first sentence: laws of Hong Kong Special Administrative Region. INDIA Limitation of Liability: The following replaces items 1 and 2 of this Section: 1. liability for bodily injury (including death) or damage to real property and tangible personal property will be limited to that caused by IBM’s negligence; 2. as to any other actual damage arising in any situation involving nonperformance by IBM pursuant to, or in any way related to the subject of this Statement of Limited Warranty, IBM’s liability will be limited to the charge paid by you for the individual Machine that is the subject of the claim. JAPAN Governing Law: The following sentence is added to this Section: Any doubts concerning this Agreement will be initially resolved between us in good faith and in accordance with the principle of mutual trust. NEW ZEALAND The IBM Warranty for Machines: The following paragraph is added to this Section: The warranties specified in this Section are in addition to any rights you may have under the Consumer Guarantees Act 1993 or other legislation which cannot be excluded or limited. The Consumer Guarantees Act 1993 will not apply in respect of any goods which IBM provides, if you require the goods for the purposes of a business as defined in that Act. A-8 IBM High Rate Wireless LAN (PCI) Card: User’s Guide Limitation of Liability: The following is added to this Section: Where Machines are not acquired for the purposes of a business as defined in the Consumer Guarantees Act 1993, the limitations in this Section are subject to the limitations in that Act. PEOPLE’S REPUBLIC OF CHINA (PRC) Governing Law: The following replaces this Section: Both you and IBM consent to the application of the laws of the State of New York (except when local law requires otherwise) to govern, interpret, and enforce all your and IBM’s rights, duties, and obligations arising from, or relating in any manner to, the subject matter of this Agreement, without regard to conflict of law principles. Any disputes arising from or in connection with this Agreement will first be resolved by friendly negotiations, failing which either of us has the right to submit the dispute to the China International Economic and Trade Arbitration Commission in Beijing, the PRC, for arbitration in accordance with its arbitration rules in force at the time. The arbitration tribunal will consist of three arbitrators. The language to be used therein will be English and Chinese. An arbitral award will be final and binding on all the parties, and will be enforceable under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958). The arbitration fee will be borne by the losing party unless otherwise determined by the arbitral award. During the course of arbitration, this Agreement will continue to be performed except for the part which the parties are disputing and which is undergoing arbitration. EUROPE, MIDDLE EAST, AFRICA (EMEA) THE FOLLOWING TERMS APPLY TO ALL EMEA COUNTRIES: The terms of this Statement of Limited Warranty apply to Machines purchased from IBM or an IBM reseller. Warranty Service: If you purchase an IBM Machine in Austria, Belgium, Denmark, Estonia, Finland, France, Germany, Greece, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Norway, Portugal, Spain, Sweden, Switzerland or United Kingdom, you may obtain warranty service for that Machine in any of those countries from either (1) an IBM reseller approved to perform warranty service or (2) from IBM. If you purchase an IBM Personal Computer Machine in Albania, Armenia, Belarus, Bosnia and Herzegovina, Bulgaria, Croatia, Appendix A. Product warranty and support information A-9 Czech Republic, Georgia, Hungary, Kazakhstan, Kirghizia, Federal Republic of Yugoslavia, Former Yugoslav Republic of Macedonia (FYROM), Moldova, Poland, Romania, Russia, Slovak Republic, Slovenia, or Ukraine, you may obtain warranty service for that Machine in any of those countries from either (1) an IBM reseller approved to perform warranty service or (2) from IBM. If you purchase an IBM Machine in a Middle Eastern or African country, you may obtain warranty service for that Machine from the IBM entity within the country of purchase, if that IBM entity provides warranty service in that country, or from an IBM reseller, approved by IBM to perform warranty service on that Machine in that country. Warranty service in Africa is available within 50 kilometers of an IBM authorized service provider. You are responsible for transportation costs for Machines located outside 50 kilometers of an IBM authorized service provider. Governing Law: The applicable laws that govern, interpret and enforce rights, duties, and obligations of each of us arising from, or relating in any manner to, the subject matter of this Statement, without regard to conflict of laws principles, as well as Country-unique terms and competent court for this Statement are those of the country in which the warranty service is being provided, except that in 1) Albania, Bosnia-Herzegovina, Bulgaria, Croatia, Hungary, Former Yugoslav Republic of Macedonia, Romania, Slovakia, Slovenia, Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan, the laws of Austria apply; 2) Estonia, Latvia, and Lithuania, the laws of Finland apply; 3) Algeria, Benin, Burkina Faso, Cameroon, Cape Verde, Central African Republic, Chad, Congo, Djibouti, Democratic Republic of Congo, Equatorial Guinea, France, Gabon, Gambia, Guinea, Guinea-Bissau, Ivory Coast, Lebanon, Mali, Mauritania, Morocco, Niger, Senegal, Togo, and Tunisia, this Agreement will be construed and the legal relations between the parties will be determined in accordance with the French laws and all disputes arising out of this Agreement or related to its violation or execution, including summary proceedings, will be settled exclusively by the Commercial Court of Paris; 4) Angola, Bahrain, Botswana, Burundi, Egypt, Eritrea, Ethiopia, Ghana, Jordan, Kenya, Kuwait, Liberia, Malawi, Malta, Mozambique, Nigeria, Oman, Pakistan, Qatar, Rwanda, Sao Tome, Saudi Arabia, Sierra Leone, Somalia, Tanzania, Uganda, United Arab Emirates, United Kingdom, West Bank/Gaza, Yemen, Zambia, and Zimbabwe, this Agreement will be governed by English Law and disputes relating to it will be submitted to the exclusive jurisdiction of the English courts; and 5) in Greece, Israel, Italy, Portugal, and Spain any legal claim arising out of this Statement will be brought before, and finally settled by, the competent court of Athens, Tel Aviv, Milan, Lisbon, and Madrid, respectively. THE FOLLOWING TERMS APPLY TO THE COUNTRY SPECIFIED: A-10 IBM High Rate Wireless LAN (PCI) Card: User’s Guide AUSTRIA AND GERMANY The IBM Warranty for Machines: The following replaces the first sentence of the first paragraph of this Section: The warranty for an IBM Machine covers the functionality of the Machine for its normal use and the Machine’s conformity to its Specifications. The following paragraphs are added to this Section: The minimum warranty period for Machines is six months. In case IBM or your reseller is unable to repair an IBM Machine, you can alternatively ask for a partial refund as far as justified by the reduced value of the unrepaired Machine or ask for a cancellation of the respective agreement for such Machine and get your money refunded. Extent of Warranty: The second paragraph does not apply. Warranty Service: The following is added to this Section: During the warranty period, transportation for delivery of the failing Machine to IBM will be at IBM’s expense. Limitation of Liability: The following paragraph is added to this Section: The limitations and exclusions specified in the Statement of Limited Warranty will not apply to damages caused by IBM with fraud or gross negligence and for express warranty. The following sentence is added to the end of item 2: IBM’s liability under this item is limited to the violation of essential contractual terms in cases of ordinary negligence. EGYPT Limitation of Liability: The following replaces item 2 in this Section: as to any other actual direct damages, IBM’s liability will be limited to the total amount you paid for the Machine that is the subject of the claim.
