HOLLYWOODIVERS CAMERA RENTAL AGREEMENT, LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK This AGREEMENT is entered into between HOLLYWOODIVERS and __________________________. (Rentor)
hereinafter “RENTOR”, for the rental Underwater Camera Housing and Camera equipment. This AGREEMENT is a release of the RENTOR’S rights to sue for injuries or death resulting from the rental and/or use of the equipment. RENTOR expressly assumes all risks of skin and/or scuba diving related in any way to the rental and/or use of this equipment.

CAMERA RENTAL AGREEMENT, LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK (continued) I UNDERSTAND HOW TO CLOSE THE CAMERA HOUSING PROPERLY. ________ I UNDERSTAND THAT I MUST REMOVE THE RUBBER EYEPIECE ON THE CAMERA BEFORE PUTTING THE CAMERA INTO THE HOUSING TO PREVENT FLOODING. ________ RENTOR Understands that a leak test without the camera inside is reccomended before submersion with camera inside.____________________ I UNDERSTAND THAT I (rentor) AM RESPONSIBLE FOR ANY AND ALL DAMAGE, INCLUDING FLOODING, that occcurs WHILE equipment is IN MY POSSESSION. ________ RENTOR IS Responsible for all damages that occur while in use by said RENTOR. These damages include but are not limited to Sand and or Dust Damage, Scratches of Ports and or Broken or Missing pieces. Misplaced items such as zoom gears and or Camera Trays / Mounts will be paid at full retail cost if lost or stolen. RENTOR hereby acknowledges recept of the equipment designated on this form, and, if any of this equipment is to be used for scuba diving, that RENTOR is a certified scuba diver or student in a scuba diving course/ program under the supervision of a certified scuba instructor. ________ RENTOR acknowledges that the equipment is in good working condition and that he/she has examined the equipment to ensure that it is free from defects, and that the user knows how to properly work the equipment._______ RENTOR also understands that HOLLYWOODIVERS and its employees, owners, officers, or agents (hereinafter “Released Parties”), shall not be held liable or responsible in any way for any injury, death or other damages to RENTOR or his/her family, heirs, or assigns which may occur as a result of the rental and/or use of the equipment, or as a result of product defect, or the negligence of any party, including the Released Parties, whether passive or active. _______ I, ____________________________, HAVE CAREFULLY READ AND UNDERSTAND THE ABOVE AGREEMENT. BY SIGNING THIS AGREEMENT, I EXEMPT AND RELEASE HOLLYWOODIVERS AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH AS A RESULT OF RENTING AND/OR USING THIS EQUIPMENT, HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. ______________________________________________________ (RENTOR’S SIGNATURE)
