SCHEDULE OF WAGES AND CONDITIONS FOR STAGE PRESENTATIONS

-2DEFINITION OF A STAGEHAND The term "stagehand" shall include: stage carpenter, head carpenter, stage electrician, sound technician, heads of departments and assistants, spot operators, truss spot operators, board operators, stagehands, wardrobe personnel, grid and fly personnel, properties personnel, riggers, climbers, ground rigger assistant, street loaders, scenic artists, painters, hair, wig and make-up artists, audio-visual personnel, fork lift operators, carloaders and all other departments under the jurisdiction of I.A.T.S.E. From henceforth referred to as the stagehand. Furthermore, the handling and placing and operation of scenery, curtains, properties, electrical effects, spotlights, sound accessories, video-tape equipment, audio-visual equipment and any other paraphernalia coming out of the jurisdiction of the I.A.T.S.E shall be performed by qualified stagehands referred by Local 63 I.A.T.S.E., affiliated with the AFL-CIO, CLC, MFL & WLC. CONDITIONS
1. MINIMUM CALL: The minimum call will be four (4) consecutive hours, except the performance call, and shall start on the hour or the half hour. When a stagehand has more than a one (1) hour break between calls for the same Employer, the stagehand shall commence a new four (4) hour call.
2. The standard hours of work will be eight (8) hours. Where a stagehand is required to work for more than the standard hours of work in any day, that hourly rate will be paid at time and one half (1 1/2) the base hourly rate. Therefore time and one half (1 1/2) the base hourly rate after eight (8) hours. When a stagehand works twelve (12) hours in a day, the thirteenth (13) hour and all remaining hours in that day shall be paid at double (2) the base hourly rate. When a stagehand is required to work more than forty (40) straight time hours in any one (1) week, for the same Employer, then time and one half (1 1/2) the base hourly rate would apply.
3. Where a stagehand is required to work between the hours of twelve (12) midnight and eight (8) a.m. the rate will be double (2) the base hourly rate.
4. Where a stagehand is required to work after eight (8) hours of time and one half (1 1/2) the base hourly rate; double (2) the base hourly rate would be applicable.
5. There shall be a minimum eight (8) hour rest period from the end of work in one (1) day and the beginning of work on the next day, for the same employer. Encroachment of the eight (8) hour rest period shall be paid by the Employer at double (2) the base hourly rate and remain in effect until the next rest period that extends past eight (8) hours.
-36. Where a stagehand is required to work on a Sunday, time and one half (1 1/2) the base hourly/performance rate shall apply. 7. HOLIDAYS: Holidays shall be: NEW YEAR'S DAY, GOOD FRIDAY, EASTER SUNDAY, VICTORIA DAY, CANADA DAY, THE AUGUST CIVIC HOLIDAY, LABOUR DAY, THANKSGIVING DAY, REMEMBRANCE DAY, CHRISTMAS DAY, and BOXING DAY and any other holidays deemed by the Municipal, Provincial or Federal Governments. On the above Holidays, the overtime rate shall be paid at a rate of time and one half (1 1/2) the base hourly/performance rate as set forth in the Schedule of Wages. On Christmas Eve and New Year's Eve, where a stagehand is required to work past 5:00 p.m., double (2) the base hourly/ performance rate shall apply. All Holidays shall be celebrated on the dates set by the Federal and/or Provincial Governments. 8. MINIMUM CREW: The minimum crew shall be the Heads of Department when the stage is in use. 9. No stagehand shall be laid off or replaced in order to avoid the payment of overtime or a higher rate in reference to set-ups, performances and/or tear down.
10. CARLOADERS: All stagehands performing work as Carloaders engaged in the work of loading or unloading any truck, railroad car, van, bus or other vehicle, shall be paid the base hourly stagehand rate. Minimum four (4) hour call. When a Carloader is required on Remembrance Day the Remembrance Day Act shall be applicable. All other holidays and/or Sundays are paid at the applicable overtime rates.
11. COFFEE BREAKS: Coffee breaks are to be scheduled no later than half way through the work call of four hours, shall be no less than fifteen minutes long and shall be of continuous time duration. If a five-hour block of work is scheduled, the coffee break shall be no later than half way through that work call (or, in other words, no later than two-and-one-half hours after the commencement of the five-hour work call). Coffee breaks may be staggered between departments upon agreement between the producer’s agent and the House Carpenter and/or the Union’s Business Agent.
12. MEAL PERIOD: All stagehands shall receive a meal break of one (1) hour after every four (4) hours of work (unless the fourth hour is the end of the work day) or the fifth (5th) hour (where a scheduled meal period is in effect) is to start at double (2) the previous hourly rate that was in effect; but not to exceed double (2) the base hourly rate; and shall remain in effect until a onehour meal is given or the end of the work day. A meal period will not be required following a performance unless the tear down and load out, following the performance, exceeds four hours and the meal may be a paid half hour with a suitable meal provided by the employer or it will be a one hour non-catered meal period. No stagehand shall be given less than two (2) hours of work after a one (1) hour meal break. If a five-hour work call is agreed to and permitted to be followed by a three-hour work call then there must be a one hour meal period or a paid half hour meal period at the end of fifth hour and a mandatory one-hour meal period at the end of the eighth hour. If the five-hour work
-4call continues into a sixth hour, then the fifth and sixth hours will be paid at double the rate in effect at the time of the infringement and will continue at that new rate until a full one-hour meal period occurs. If the work call goes into a fourth hour of the three-hour work call after a five-hour work call has been in effect (and where no penalty has occurred after the five-hour work call) then the penalty shall be double the rate in effect for every hour of work until a one-hour meal period is given. There shall be no paid half hour in this instance unless the call extends into a performance. Meal breaks, which are taken for one (1) hour, shall not be paid for. However, if the Employer desires to have the stagehands take a meal break of less than one (1) hour, the stagehands will be given a paid half (1/2) hour with a meal provided or a paid half (1/2) hour with the sum of $21.55 per stagehand be paid out as meal money, on a separate I.A.T.S.E., Local 63 invoice [payroll sheet(s)] and this applies to regular calls based on four-hour blocks of time. The half (1/2) hour meal breaks may be staggered by the House Steward. When breaking for half (1/2) hour meals and staggering crews, the first break must take place a half (1/2) hour before the end of the four (4) hour period and second break must be on the hour. When a stagehand is working between the hours of 12:00 a.m. and 8:00 a.m., double (2) the base hourly rate is applied, and a meal break must be given after four (4) hours of work or a meal penalty of one (1) hour at the base hourly rate will be applied for each hour worked until a meal break of one-hour is given. If the half hour paid meal is agreed to, it must come no later than the end of the fourth hour. The half (1/2) hour meal breaks may be staggered by the House Steward. When breaking for half (1/2) hour lunches and staggering crews, the first break must take place a half (1/2) hour before the end of the four (4) hour period and second break must be on the hour.
13. DEFINITION OF PERFORMANCE: Three (3) hours or less shall constitute a performance call. In the event the performance runs longer than three (3) hours, each additional hour shall be paid at time-and-one-half (1 ½) the base hourly rate. A performance may last a maximum of three (3) hours. This shall not mean that an Employer may utilize the stagehands after a performance of shorter duration for other work to fulfil the three (3) hour maximum. However, the striking of the last act shall be considered part of the performance, so long as it takes place in the three (3) hour maximum. If the striking of the last act takes place after the three (3) hour maximum it shall be treated the same as a performance that extends to more than the three (3) hour maximum. This shall not be considered to mean a new set up for another performance nor the dismantling and tear-down of a show. A performance is a complete run through of a production containing all of the elements of the production on the stage and is continuous from start to finish whether there is an audience or not. The performance is completed upon the "curtain coming down" on the final section of the production (show) whether it actually does or is perceived by the House Carpenter as the completion of the performance where a curtain would metaphorically occur. Any work done following a performance shall be charged at the applicable rate in effect and shall be no less than time-and-one-half the base hourly rate.
DEFINITION OF REHEARSAL: Rehearsal shall be classified as performances and paid for as such. All hours worked prior to and after a rehearsal or a performance shall be paid for at the
-5applicable base hourly rate. A rehearsal is hereby defined as a period during which any Employer uses the scenery, electrical equipment, sound equipment or props required for its production. This definition specifically excludes a rehearsal on a bare stage or an orchestral or choral reading in which the group is in no sense rehearsing a complete run-through of the show and for which such stagehands as are required shall be employed on the hourly rate.
14. Where a stagehand has worked the Performance and proceeds to the dismantling/tear down of the show; time and one half (1 1/2) the base hourly rate shall apply unless on a Sunday or holiday or when the call goes past midnight where double (2) the base hourly rate shall apply.
15. HOLIDAY PAY: The sum of six percent (6%) of the gross wages shall be paid to the stagehands as holiday pay.
16. CANADA PENSION PLAN, EMPLOYMENT INSURANCE, LIABILITY INSURANCE, WORKERS COMPENSATION, PAYROLL SERVICE and HEALTH BENEFIT: The sum of eighteen percent (18%) to be paid to Local 63 on the gross earnings.
17. In accordance with the Payment of Wages Act, Section 3, Subsection 1 (b), monies owing to I.A.T.S.E. Local 63 must be paid within five (5) working days.
18. Any variations to these conditions cannot be made without prior discussion with the Business Representative of Local 63 or his/her authorized agent.
19. If less than a one (1) hour break between show calls then: a) A satisfactory meal must be brought in and supplied, or: b) A penalty of one (1) hour will be charged at the stagehand hourly rate and applied to each stagehand on a separate I.A.T.S.E., Local 63 invoice (payroll sheet[s]).
20. Any call that exceeds twenty (20) stagehands, the Employer will be billed for one (1) stagehand at the stagehand's base hourly rate to complete the payrolls. Minimum four (4) hour call.
21. Any special requests in rates and/or conditions have to be discussed with the Business Agent. The Promoter/Producer will be allowed one five-hour call for the entire crew as the first or initial call of the day for the set-up (fit-up) of the show but the crew cannot work more than a three hour block following a one hour or paid half hour lunch break when this clause is invoked. The initial call of the day cannot exceed five hours without a penalty incurred. No call shall be longer than eight hours of regular time.

Safety Clause The Employees will not be required to work, handle or set up scenery, properties, effects, drapes, drops or other stage decor or any electrical stage equipment or projection equipment which is deemed unsafe by I.A.T.S.E. Local 63. i) I.A.T.S.E. Local 63 works in accordance with the Manitoba Occupational Health and Safety guidelines for the province of Manitoba.
