ANNEXURE SCOPE OF WORK, TERMS AND CONDITIONS TO THE TO THE SERVICE CONTRACT FOR HOUSE KEEPING, CATERING SERVICES, SECURITY SERVICES AND MAINTENANCE OF GARDEN AT INSPECTION BUNGLOW/HVF,AVADI, CHENNAI – 600 054. I. PERIOD, SCOPE OF WORK AND SERVICES 1. The contract will be valid for a period of one year (365 working days) from the date of commencement of the work. 2. RECEPTION: To co-ordinate room allocation, bookings, check-in and check-out of guests, answering the phone calls, preparation of bill & collection of accommodation and messing charges from guests and deposit of accommodation and other charges to HVF management representative. 3. HOUSEKEEPING: To render all housekeeping and conservancy services of highest standards befitting the status of Inspection Bungalow, HVF. 4. CATERING SERVICES: a. To render food and beverage services of highest standards. b. To extend special services as required by HVF. 5. GARDEN MAINTENANCE: a. To maintain the existing lawn and garden in the front and surrounding area of IB/HVF and application of manure, pesticides, etc., regularly and removal of weeds and wild growth. Such activity will not be limited to watering and de-weeding only. The contractor will ensure that the garden and flower beds are always having seasonal and perennial flowers. For this purpose, he will plan, plant and replace flower plants on seasonal and perennial on periodical basis. b. To prepare flower beds and ensure planting of flowering plants regularly. 6. SECURITY SERVICES: To provide round the clock security service by detailing uniformed chowkidars. 7. LAUNDRY: a. To render laundry services of high standards for HVF Linens, blankets and curtains. b. To render laundry services for staying guests on chargeable basis at a reasonable prevalent rate, after consultation with HVF Management on mutually agreed rates. II GENERAL ADMINISTRATION The contractor has to follow the terms and conditions strictly. The Contractor, before submitting his offer against the tender, may visit the places for his own assessment, inside Inspection Bungalow/HVF with the permission of HVF Management. To co-ordinate with respective sections for smooth running of the guesthouse and maintain all the records as required by HVF Management. 1.0 1.01 1.02 1.03 SUPERVISION To supervise the employees deployed by the contractor. To supervise normal meals from time to time. To supervise all the meals during the visit of VIPS or special lunch or dinner. Contd--2-- --2-2 RECEPTION 2.1 Check-In procedure. 2.1.1 When the guest Check-in, the Contractor/Contactor's staff shall immediately attend to him, receive him, and allot the suite earmarked for him. HVF will reserve the rooms and intimate the Contractor accordingly. The contractor shall not allot rooms on his own, for any reason. 2.1.2 Get the guest's name entered in the Guest Register to be provided by HVF. 2.1.3 Guide the guest to his room, carrying his baggage and look for his comforts, keep fresh water, Linen, towels and other amenities. 2.1.4 Offer him tea/coffee/meal, etc., as required by him, depending on the time. 2.2 Check-out procedure. 2.2.1 When the guest Check-out, separate bills for messing and lodging are to be prepared and get the same signed by the guest. It will be the duty of the contractor staff that at whatever time the guests leave, they are billed and charged. 2.2.2 The Contractor shall collect the money from the guest and deposit the amount collected against lodging bill to HVF, while retaining the messing bill amount for the messing facilities provided by him. 2.2.3 Carry the guest's baggage from the room to the vehicle. 2.2.4 To ensure that the guest has not left behind any of his belongings in the room. If any such belonging is found, the same is to be immediately informed to In-charge, Inspection Bungalow/HVF who will arrange for sending the same to the guest. 2.3 During stay, the guest's miscellaneous needs like laundry are to be attended to. Charges for these services may be collected from the guest on actual basis, providing relevant bills. 2.4 A register is to be maintained at Inspection Bungalow/HVF where entries of all those who are visiting other than the occupants of Inspection Bungalow/HVF should be made with the identity and purpose of the visit with their signature. Contractor should ensure that no unauthorized person enters the Inspection Bungalow/HVF premises. 2.5 Minimum number of staff & employees to be deployed by the contractor is as shown below. Contractor should deploy the man power as per shift basis only. The contractor should provide one day weekly off to each staff/worker after completion of continuous six working days. On weekly off day, contractor should provide the relievers. It should also be ensured that the Seminar hall, dining hall and lounge are always ready for use at any time. 3.04 For cleaning purpose, all required sufficient tools and other materials are to be brought by the contractor. The factory will provide the cleaning materials for rooms, toilets, kitchen and open areas. Contd--4— --4-3.05 The floors of all the rooms wherever not carpeted will be cleaned daily with detergent chemical (eco-friendly) and will be kept clean all the time. Cleaning of toilets, commode /WC Pan, washbasin and floor area with 'Sanifresh' or 'Harpic', Phenyl twice daily i.e., morning and afternoon. Cleaning materials like soap, deodorant, room freshner, toilet paper, lizol, Harpic, Odonil stick, phenyl, etc., (eco-friendly cleaning materials) shall be provided by the Factory Management. 3.06 The contractor shall make beds and clean all the rooms daily. Changing of bed linen and towels etc., is to be done in the rooms whenever allotted and twice in a week when the rooms are in continuous occupation. The required number of linen, towels etc., will be provided by the factory. The Contractor has to do laundry work for bed linens, towels, bed spreads, blankets (Dry clean), Pillow covers etc., at his cost. The room should be well maintained. Housekeeping includes dusting of sofa sets, Television, Air Condition, Furniture etc., & removal of cobwebs. The blankets and the curtains should be cleaned on quarterly basis (dry cleaned only). However the blanket cover will be changed like that of linen. 3.07 Rooms will be sprayed with room freshener daily whenever the room is prepared for the Guest. Odonil will be provided in all the bathrooms/Toilets. Toilet / Bath soap (small size) and towel (medium size) shall be provided by the factory management. 3.08 To make arrangements for time to time washing/cleaning of all soiled linen items used by the guests. 3.09 Conservancy works includes Sweeping, mopping, collection and dumping of garbage in the designated dustbins inside as well as outside the compound of Inspection Bungalow/HVF. Cleaning, moping and swabbing of rooms, corridors, staircases and other constructed areas floors of IB/HVF twice a day. Removal of cobwebs, fallen leaf collection, cleaning of lawns and leveling of lawns by grass cutting machine in all the areas of IB/HVF regularly. 3.10 The contractor should ensure security of the fittings, fixtures, furniture, soft furnishings and other items available in the Guest House. He should ensure cleaning of all furniture and furnishings including ceiling fans, pedestal fans, windows, glass panes, electrical fittings, Air Condition units daily. In case of any loss in any manner, the contractor shall replace them with the items of equal quality. Fridge, Television, Dish-Net Units and Computer with accessories wherever provided shall also be dusted and cleaned without damaging them. 3.11 The carpet fixed in the rooms shall be brushed and vacuum cleaned on daily basis. 3.12 The contractor's men shall take care of the wall calendars, clocks, AC & TV remote, Aquarium, Washing Machine etc., provided in the guesthouse rooms and other place and ensure changing of batteries whenever and wherever required. Batteries will be provided by the HVF for the same. 3.13 All the rooms are to be checked for bed, towel, soap, water supply, functioning of TV, Refrigerator, Air Conditioner, geyser, light fitting, bathroom fittings, etc., 3.14 Cable TV/Dish TV charges for all TVs available in the IB/HVF shall be paid by the contractor and the same may be claimed from HVF on actual basis, as per requirement of HVF, channels will be provided by the contractor. Contd--5-- --5-4.00 4.01 CATERING SERVICES The menu for Breakfast, Lunch and Dinner will be as per the details shown in the following "Annexure 'A-1'. The same dal should not be used / served twice a day. Green salad should include cucumber, tomato, chilli, lemon and onion (minimum four items in salad). 4.03 The details of the snacks to be provided, when demanded by the guests, and their rates is shown in the following "Annexure 'A-2'. The HVF management reserves the right to change / modify any menu for time to time. However, prior intimation will be given to the service provider to enable him to prepare himself for the new menu. 4.04 Any change in the menu shall be done in consultation with the management. The menu may be altered for specific guests / special occasions / programmes / functions as desired by HVF, within the overall scope of the menus. For any extra items not contemplated in the Annexure, the Contractor may charge additionally at mutually agreed rates. Breakfast, lunch and dinner for all other suites except VIP suites, will be served only in the dining hall (exempted in special cases). Room service shall be provided in VIP suites only when desired by the VIP guests as directed by HVF management. 4.09 The Contractor shall take orders before hand from the guests regarding their food requirements. The departments of HVF can also place separate order on the Contractor for any official programmes / functions / special occasions which have to be catered through In-Charge, IB/HVF. 4.10 The contractor shall suitably display the menu with details and rates in the dining areas for the meals and breakfast. The contractor for should ensure that all the raw materials should be available at least one day in advance. 4.11 The meals timings shall be as follows:Bed tea / coffee Breakfast Lunch Dinner - 06:30 AM 08:00 AM 01:00 PM 08:00 PM to to to 09:00 AM 02:30 PM 09:30 PM 4.12 Adequate Paper napkins should be kept on the dining table before the commencement of meals for the convenience of the guests. 4.13 To provide Tea/Coffee/Soft drinks, breakfast, lunch and dinner as per the requirement of the guests/occupants of the suites when allotted by the HVF Administration. 4.14 Arranging official lunch and dinner as and when ordered by the competent authority of HVF Management. Contd--10— --10-4.15 Required kitchen equipment, crockery / cutlery shall be provided by the factory. The contractor is to ensure that the items are maintained properly at all times. The crockery/cutlery damaged or broken by the contract staff shall be replaced by the contractor with crockery/cutlery of same quality immediately. Cooking Gas will be provided by the Contractor. 4.16 In case of parties, additional crockery/ cutlery shall be provided by the HVF. The contractor is to ensure that the above items are maintained properly at all times. The crockery/cutlery damaged or broken by the contract staff shall be replaced by the contractor with crockery/cutlery of same quality immediately. Repair work for the electrical appliances / furniture will be arranged by the HVF. 4.17 Contractor has to serve the food as per the prescribed menu approved by HVF Management. There will be no compromise on food quality. If there is any non-compliance of food quality of any items of the menu, the total amount of that particular Breakfast / Lunch / Dinner / Party etc., will be deducted from the cost of the menu. It will be done on the basis of the food related complaints endorsed by the guests in food complaint register, available with Incharge, IB/HVF. After seeing the genuiness of the complaints by the HVF representative, necessary action will be taken in this regard. 4.18 Food and Accommodation to the contractor men will not be provided by the HVF Management. Only change rooms will be provided to the contractor men (not more than three rooms. One for cooks and other room for other categories workers, for ladies separate change room will be provided). 4.19 Cooking shall be done in hygienic conditions for which a trained Cook and Assistant Cook should be detailed in all the shifts. The contactor shall detail presentable, well-mannered and trained attendants. 4.20 Kitchen will always be kept clean in a spic and span condition. Cutlery and crockery as well as cooking utensils will be kept spotless by cleaning with standard scouring powder and scrubber. Utensils / Crockery cleaning materials including and scrubbers etc., will be provided by the factory. 4.21 Cooks must turn out in clean hygienic condition and must be free from any diseases. Their Medical check-up should be carried out once in six months and a medical certificate, as proof of the check is to be produced from AMA/Regd. Medical practitioner or from HVF Hospital. If in the opinion of the factory, any employee of the contractor is found to be suffering from any disease, the factory at its sole discretion may ask the contractor to remove such employees without questioning the decision of the factory in this respect and factory will be entitled to restrict such employee from entering the premises. 5.00 GARDEN MAINTENANCE a). Maintenance of existing Gardens i.e., Inspection Bungalow/HVF. b). Daily watering of plants by using requisite hoses, sprayers or by any means & regular removal and disposal of weeds. In case of water scarcity, contractor may arrange water from water hand pumps. c). Regular trimming of edge plants, mowing of lawn, removal of shrubs / wild bushes, bushes along the inner and outer periphery of gardens. Contd--11-- --11-d). Regular / periodical applying of pesticides (30 kgs.), fertilizers (50 kg.), manure (4 load / 2 units) etc., Regular mowing of Lawn once in one month. e). Regular changing of dead / damaged plants with new plants. Planting and changing of seasonal flower plants and perennial flower plants. f) Contractor will have to provide one professional Gardener for this work and the Gardener will take care of gardens at Inspection Bungalow/HVF. g) Contractor to arrange / provide the gardening tools, hoses, sprayers and equipments etc., Factory management will not provide any materials / tools and equipments etc., for gardening purpose. h) Arranging / providing of 250 nos. of new flower plants with earthen pots (Big Size) as per following Annexure 'D'. i) Painting of border bricks, trees trunks to the high of 05 feet once in two months with white lime and laying / changing of broken bricks. j) Trimming of horizontal tree branches, dried branches disposal of garbage / waste materials from the garden. k) In case of non-availability of required flower plants / plants with pot, the contractor has to provide same quality of other plants as desired by HVF Management. l) The contractor will provide Petrol driven lawn mover and bush cutter to clean the bushes and maintaining the grass of the lawns of IB/HVF. He will also arrange to make the flower beds inside the parameter wall of IB/HVF (contractor will provide the seeds also of the flowers as per Annexure-‘E’ for flower beds). m) Planting /changing of seasonal & perennial flower plants for two years as per the following Annexure 'D'. X-mas Tree - 25 nos. -------------TOTAL - 250 Nos. -------------Contd--12-- --12-6.00 SECURITY SERVICE: 6.01 The Contractor has to deploy Chowkidar at the Inspection Bungalow/HVF. He will be responsible for the security of the men and materials available at IB/HVF. 6.02 The chowkidar should be presentable and his health condition should be of required level so that he can discharge his security duty effectively and efficiently. He will strictly be attired in uniform and shoes at all times. He should be vigilant at all times and report any untoward incident within the premises of the Inspection Bungalow immediately to the HVF representative available. 6.03 He should always be alert and pay proper compliments to the officers and should ensure the identity of the guests before allowing them inside the premises. In case of any doubt, the visitor should be requested to report to the reception. 6.04 He should patrol the entire premises of the Inspection Bungalow regularly at all times. He should ensure that all the security lights are switched on at dusk and switched off at dawn. The chowkidar will check the serviceability of all the light fittings and submit a report to the HVF staff on daily basis. 7.00 7.01 LAUNDRY SERVICE: The Contractor shall provide all management, manpower and systems for efficient and timely laundry services for the guesthouse. i). To render laundry services of higher standard following manner. a). Quilts / Blankets / Curtains dry cleaning on monthly basis. b). Double bed quilt covers / blanket covers will be dry cleaned on weekly basis. And when the new guest arrives it will be replaced immediately with the new one. Double bed quilts / double bed blankets covers are 14 in nos. c). Single bed quilts covers / single bed blanket covers should be washed and ironed on every week. Total nos. of single bed quilt covers / single bed blankets covers are 60 in nos. and when the new guest arrives it will be replaced immediately with the new one. d). Double bed sheets should be washed and ironed on weekly basis. Total nos. of double bed sheets are 14 in nos. and when the new guest arrives it will be replaced immediately with the new one. e). Single bed sheets and pillow covers should be washed and ironed on weekly basis. Total nos. of single bed sheets are 60 in nos. Total nos. of pillow covers are 60 in nos. f). Single bed spreads should be washed and ironed on fortnightly basis. Total bed spreads (single) are 60 in nos. g). Double bed, bed spreads should be dry cleaned on fortnightly basis. Total nos. of double bed spreads are 14 in nos. h). Towel big are 70 in nos., small towels are 70 in nos. it should be cleaned twice in a week. ii). To render laundry services for staying guests on chargeable basis at a reasonable prevalent rate, after consultation with HVF Management on mutually agreed basis. 7.02 Bed linen, towels, napkins, curtains, furniture upholstery shall be periodically washed and kept in clean condition for use. Soiled/ wrinkled linen shall not be used in the rooms on any account. Contd--13-- --13-7.03 Weekly cleaning of 125 nos. of linens which includes bed sheets, bedspreads, Pillow covers, blanket covers, towels etc., hence in a year (125 X 52 weeks), 6,500 Linens are required to be cleaned by the contractor. 7.04 The Contractor should provide detergents for laundry washing. He should use his own iron for pressing the clothes. 7.05 HVF shall provide Washing Machine, Water and Electricity along with adequate space. 7.06. Dry cleaning of 14 nos. of double blankets / quilts on monthly basis hence total 56 double blankets / quilts in a year, dry cleaning of 50 curtains in quarterly basis and total 200 curtains in a year is the responsibility of the contractor. 7.07 It may be noted that the price agreed includes charges for laundering of the HVF cloths like bed sheets, covers, linen, towels, etc., however, the contractor shall charge from the guests for washing and pressing of guest's clothes at mutually agreed rates. Rates should be displayed in the rooms. 8.00 UNIFORM FOR THE EMPLOYEES 8.01 Contract Supervisor, stewards and housekeepers should wear black pant, white shirt, black shoe and tie. Cook and Assistant Cook should wear white pant white shirt with apron, cap & black shoes. Chowkidars should wear dark blue pant, light blue shirt with black belt, black shoe and cap. All other workers should wear maroon jacket with black shoes. He should provide two sets of uniforms for all the workers and supervisors. 9.00 SUPERVISION AND QUALIFICATION 9.01 The Contractor's supervisor shall be sufficiently by professionally qualified (Degree/Diploma/Certificate of not less than one year duration in Hotel Management/Catering from a recognized Institute) and with experience on the job to ensure smooth operation of the services as set forth in the Scope of Work and services. He should be conversant with English and Tamil and should have working knowledge of Hindi. 9.02 The contractor shall detail supervisors for all the shifts. There will be different supervisors for different shifts. The contract Supervisor has to supervise all meals from time to time and to supervise all the meals during special lunch or dinner or parties etc., 9.03 The supervisor shall not be counted against any other staff. The supervisor shall not be allowed to perform the duties of cook or housekeeper or steward. The supervisors, so detailed by the contractor shall be exclusively for this contract. The contactor shall not be allowed to detail him for any other duty or against any other contract in HVF. Contd--14— 9.04 9.05 --14-For Stewards, they should possess the Diploma/Certificate from the recognized Institute of minimum 06 months duration in “Food & Beverages Service” or should have a one year experience in Three Star Hotels/Central Govt. Guest Houses/Public Sectors owned guest houses as a Steward. (The contractor should furnish a proof of the same with satisfactory work completion Certificate in respect of Steward from the Organisation where he worked for one or two years). The Cook (Head) should preferably possess the minimum qualification of Matriculation / 10th standard Passed. He should have a minimum 03 years working experience in Three Star Hotels/ Central Government / State Government / Public Sectors Unit owned Guest Houses or in ISO Certified Hotels as a Cook. For Asst. Cooks, he should be preferably matriculation / 10th Standard passed and minimum One year experience in Three Star Hotels/ Central Government / State Government / Public Sectors Unit owned Guest Houses or in ISO Certified Hotels as a Cook. (The contractor should furnish a proof of the same with satisfactory work completion Certificate in respect of Cook (Head) and Cook from the Organisation where he worked for one or two years). 9.06 The contractor should have a minimum three years experience in Running the Central Govt./State Govt./Public Sector owned Guest Houses/Three Star Hotels or in ISO Certified Hotels. (Proof of the same should be furnished with satisfactory work completion Certificates from the Organisations where he worked as a Contractor for three years). 10.00 CONTRACTOR'S PERSONNEL & ATTENDANCE: 10.01 The shift timings and the strength of staff on duty is to be decided by the contractor in consultation with the In-charge, Inspection Bungalow. Contractor shall ensure that he deploys his men (cook, housekeepers, stewards, Chowkidars etc.,) in a manner that it does not violate any labour law regarding the continuous deployment on duty of workmen with rest/shift break. 10.02 All the employees working in the Inspection Bungalow/HVF and other areas under the control of the contractor will sign daily attendance showing IN and OUT timings. This drill is compulsory since recording attendance is a security requirement. 10.03 Contractor's representative posted as in-charge at each Transit Flat/Guest House should necessarily be fluent in spoken Tamil and English and working knowledge of Hindi. 10.04 The contractor should provide one day weekly Off to his workers on rotational basis without affecting the normal working of Inspection Bungalow i.e. the contractor has to deploy manpower during the contract period of entire one year (365 working days). 10.05 The contractor should engage minimum 30% of workers from the existing contract as per the choice of HVF management, in order to maintain the continuity of the work. Balance employees shall be deployed upto the satisfaction of HVF Management. 10.06 After concluding of fresh contract contractor should not remove any contract worker without consulting HVF Management. 10.07 The contractor shall not employ any person below the age of 18 years for execution of the work. Contractor may engage workers preferably in the age group between 18 and 45 years and out of which, minimum 70% should be male employees. Female employees should not be detailed in the night shifts. Contd--15— --15-10.08 The Contractor shall be solely responsible for providing all requirements of its personnel, including a. Payment of wages and all allowances to his employees. b. Bonus to the contract workers as per the “Payment of Bonus Act 1965”, if applicable. c. Collection and payment of all taxes on behalf of his employees and any other statutory requirements such as EPF, ESI, etc., made by any Government Authority having jurisdiction. d. Prompt replacement of any personnel whose performance is unsatisfactory or whose presence is considered as detrimental to HVF interests. e. All Group insurance and security / safety aspects pertaining to Contractor's employees are the contractor's liability. f. The Contractor shall ensure that all his employees turn out in clean, appropriate uniforms and shoes, at all times on duty. The personnel shall wear caps while serving food. The Contractor shall provide necessary uniforms and liveries adequately and ensure that no employee is permitted to perform duty without uniform. If the employees are found performing duty without proper / clean uniforms, suitable action will be taken that may include full or partial recovery from establishment cost. The daily roster of the staff for the week should be made available to HVF. g. The contractor shall maintain necessary Qualified/Trained competent personnel in each category and for each work as specified. They should meet all the requirements and fulfill all the activities mentioned in the schedule. h. HVF has no responsibility whatsoever for the Contractor's employees and the Contractor will be solely responsible for managing his employees. In the event of any dispute between the Contractor and his employees, the Contractor alone will be responsible for settlement of any claim and consequences that may arise out of any such dispute, whether statutory or otherwise. i. The Contractor shall engage sufficient number of competent employees for running the IB/HVF on round-the-clock basis. Expenses on account of payment of salary / wages / provisions of food stuffs / eatables for contractor's employees / Uniform / Personal Protective Equipments, and other benefits including statutory payments like EPF, ESI, Holiday wages, Gratuity, Bonus, etc., to the contractor's employees shall be met by the Contractors. The Contractor shall have full control of his employees including the right to appoint, determine service conditions, discharge, dismiss, or otherwise terminate their services at any time. The Contractor shall be solely responsible for any claim arising out of employment or termination of employment of his employees and any other statutory payments. j. The contractor or his men will not move around the factory/estate except in the assigned area of work. k. All persons employed by the contractor and their belonging, vehicles, equipments etc., are liable for security search at any time and place. There will regular as well as surprise checking of the services provided by the contractor. Contd--16-- --16-l. The contractor and his men will ensure that no damages caused to any property of H.V.F. In the event of any damage, the amount will be compensated by deducting the same from the contractor's bill as per the prevailing market value of the things damaged. m. The contractor should provide the safety equipments and periodical safety instruction should be given to all his men. n. The contractor will not bring any article/material/stores that are not required in connection with the performance of the contract. The material of the contractor will be subject to check. o. Neither the contractor nor his men shall bring articles like bidi, cigarettes or any kind of intoxicants or any other contraband inside the estate. He and his employees will be fully responsible for any unsafe act and will liable to be proceeded against for this. p. The Contractor shall get the feedback form filled from all guests without fail. q. The Contractor’s boys shall not seek any tips or favour from the guests for the services rendered. 11.00 PAYMENT CLAUSE 11.01 Minimum wages should be paid to all contract workers by the contractor as fixed by CLC (C) / RLC from time to time. Accordingly contractor can claim such revision of minimum wages by submitting the proof for having paid the revised wages from time to time. Whenever revision of RLC rates takes place, the contract value and SD value will increase proportionately, and other taxes as applicable. 11.02 Monthly payment on pro-rata basis will be released to the contractor on production of satisfactory job completion certificate, which will be certified by In-charge, Inspection Bungalow and JWM/Transit camps. Based on the monthly job completion certificate, payment will be made through the Accounts Department. The factory management reserves the right to deduct from the bill any reasonable or proportionate amount for services found unsatisfactory or services not provided. 11.03 In case the minimum manpower as indicated above is not deployed, proportionate deduction of payment will be made and 25% of penal charges also will be deducted from the contractor's bill for the man days not provided. 11.04 Payment shall be claimed by the contractor in the prescribed bill format duly supported by the satisfactory work completion report from In-charge, Inspection Bungalow and JWM/Transit Camp. The contractor should enclose supporting documents along with the prescribed contractor bill for having paid EPF (including employers contribution) and ESI as applicable and duly certified by the ALWC (C)/DLWC (C). Income Tax @ 2% and Educational Cess @ 3% on the Income Tax will be recovered from the bill while admitting for payment. Contd--17-- --17-11.05 The contractor should ensure to open Saving Bank Accounts in any Nationalized Banks in favour of contract workers engaged by the contractors. 11.06 The contractor should ensure timely depositing (i.e. on or before 7th of Every month) of minimum rates of wages in the respective SB Accounts of Contract Labour by the contractors. 11.07 The contractor should ensure timely depositing of EPF & ESI Contributions (Employee + Employer) (i.e. on or before 15TH of every month). 11.08 The contractor should ensure to produce before the ALWC (C)/DLWC (C), register of wages / Bank Pass Books, Muster Roll, along with the certified copy of Bank statement for having deposited the minimum wages in the respective SB Accounts of Contract Labours on or before 20th of Every month. 11.09 The contractor should ensure to produce before the ALWC (C)/DLWC (C), copies of EPF and ESI Challans on or before 20ND of every month. 11.10 The contractor should ensure to produce before the ALWC (C)/DLWC (C), copy of License under CL (R&A) Act 1970 obtained from Asst. Labour Commissioner (Central) those who are engaging 20 or more 20 contract workers, soon after commencement of the contract work. 11.11 As per the provision of C.L. (R&A) Act 1970 Section 12 (1) every contractor who engages 20 or more than 20 they have to obtain a license from the concerned Asst. Labour Commissioner (Central) soon after commencement of the Contract work. 11.12 As per the provision of EPF and ESI every contractor has to deposit the contributions' deducted from their contract workers along with their matching contributions' on or before 15th of every month. Failing which the contractors are liable to pay damages as mentioned below: (a). Less than 2 Months - 7% per annum (b). 2 Months and above but less than 4 months - 22% per annum (c). 4 Months and above but less than 6 months - 27% per annum (d). 6 Months and above - 37% per annum. 11.13 The contractor should return the original Supply Order along with the final bill. 11.14 On receiving the work order, the contractor shall also give in writing under his signature and seal that he agrees to abide by all the terms and conditions of the contract. 12.00 SUBLETTING The contractor shall not sublet, transfer or assign the contract or any part thereof without the previous written approval of HVF to any other person/company/ organization. Contd--18— --18-13.00 PENALTY CLAUSE : 13.01 For deficiency in maintenance of guest houses, reduction of materials/labour cost pro-rata shall be effected. 13.02 Periodical review of complaints book shall be done and if contractor is found responsible for deficiency in services/behavior, suitable action shall be taken by the HVF and partial/full security deposit shall be forfeited. 13.03 In case the minimum manpower as indicated above is not deployed, proportionate deduction of payment will be made and 25% of penal charges also will be deducted from the contractor's bill for the man days not provided. 14.00 SPECIFIC REQUIREMENTS : 14.01 The contractor shall be responsible for payment of dish/cable connection for available TV’s at all suites and lounges and other taxes as levied by the other Govt. authorities from time to time (at Present 17 Televisions are available) and same may be claimed by the contractor on actual basis. 14.02 Newspaper/periodicals will be made available at actual cost to the visitors if demanded/required by the guests apart from the newspaper/periodicals provided by the contractor. 14.03 The contractor will provide the following newspapers and periodicals at IB/HVF. Daily Newspapers Magazines (i) The Hindu (English) (i) India Today (English) (ii) Times of India (English) (ii) Front line or The Week (English) (iii) Hindustan Times (English) (iii) Sarita (Hindi Magazine) (iv) DailyThanthi (Tamil) (iv) Kadambini (Hindi Magazine) (v) The Rajastan Patrika (Hindi) (v) Aval Vikatan (Tamil Magazine) 14.04 The contractor has to provide the required staff for store, kitchen, dining hall and the other rooms with uniforms and shoes round the clock. He should provide 02 sets of uniform to the supervisors and other workers. 14.05 All contact employees should have proper dress code for easy identification by indicating the contractor’s symbol. The uniform and shoes to the contractor’s employees will be supplied by the contractor himself [a). 02 sets of uniform which inclusive of Pants, Shirt, Cap, Tie with Shoe for Cooks, Housekeepers, Chowkidars, Stewards and Supervisors and b).02 sets of Maroon Jacket with Shoes for Sweepers, Conservancy workers, Gardener and Dhobi]. 14.06 Additional manpower as and when required, on special occasions, will also be arranged by the contractor, for which the contractor would claim the amount subsequently by submitting a separate bill. In particular, for large official functions and during VIP visits, the contractor shall deploy extra specially trained cooks and waiters. 14.07 The contractor shall at all times maintain the required number of trained cooks, waiters, room attendants and other staff as specified by the HVF Management. He shall not engage the same set of staff/men for all the shifts and shall rotate them in a manner which complies with the requirement of labour laws. Contd--19-- --19-14.08 The staff detailed by the contractor at the guest House should attend all telephone calls when the factory supervisory staff is not available. He should note down all the messages received and the same should be conveyed to the factory supervisory staff on his arrival. 14.09 If the IB/HVF at any time requires the contractor to do any work beyond that provided within the scope of work detailed in the terms and conditions of contract, due to certain exigencies the contractor shall undertake such additional work as and when required by the Factory Management. 15.00 GENERAL TERMS AND CONDITIONS 15.01 Obtaining the labour licence before commencement of the contract work from the competent authority is the responsibility of the contractor, if engaged twenty or more than twenty workers. 15.02 The firm should have executed service contracts in the past and should have got valid license for that contract from the appropriate authority. 15.03 Contractor must have Income Tax PAN, EPF No. & ESI No. to be obtained, if applicable, within one month from the award of the contract. 15.04 The contractor has to provide the required staff for store, kitchen, dinning hall and the other rooms with uniforms and shoes round the clock. He should provide 02 sets of uniform to the supervisors and other workers. 15.05 The contractor shall employ only adult workers for work whose age preferably between 18 to 45 years. 15.06 Any change in the working staff shall be done by the contactor in consultation and with the concurrence of GM/HVF or his authorized representative. 15.07 The contractor shall deploy his staff for the contract work at his own risk and cost. The contractor’s staff will not be treated as factory staff for any purpose whatsoever and facility/benefits entitled to factory staff will not be applicable to contractor’s employees. 15.08 The contractor shall be responsible for strict compliance of all statutory provisions of the relevant labour laws applicable from time to time and particularly of the State of Tamil Nadu for carrying out the above job. If due to any reason whatsoever, factory management is made liable to pay any liabilities of the contractor under any of the said laws and enactments etc., the factory management shall recover the same from the dues payable by the factory to the contractor and /or from the security deposit furnished by the contractor with Factory. 15.09 The contractor shall extend EPF and ESIC benefits as provided under the relevant laws to all his employees from the date of commencement of the contract. For the said purpose, the contractor shall get his establishment registered under the Employees Provident Fund and Miscellaneous Provisions Act 1952 directly with the appropriate Regional Provident Fund Commissioner. He shall also get himself registered with the Employees State Insurance Corporation authorities. 15.10 The contractor shall be responsible for fulfilling the requirement of all the statutory provisions of minimum wages, Payment of Wages Act, Payment of Bonus Act, Gratuity Act, Industrial disputes Act, Contract Labour (Regulation and Abolition) Act. 15.11 The contractor will not allow or permit his employees to participate in any trade union activities or agitation in the premises. Contd--20-- --20-15.12 The contractor should conduct surprise checks of his staff meant for the above service and also for their punctuality and behaviour. 15.13 The contractor should hand over all items to the factory representative or to the incoming contractor whenever the contract is changed due to any reason whatsoever. Proper handing and taking over should be carried out in the presence of the factory representative and a certificate on this account should be prepared and signed and submitted to HVF representative. 15.14 The contractor has to deposit security deposit @ 10 % of the total value of the contract within 30 days from the date of contract. The same will be returned after 02 months from the date of completion of contract. 15.15 The release of the security deposit is subject to the production of clearance certificate to be issued by the ALWC(C)/DLWC(C) of HVF. Clearance certificate may be issued by ALWC(C)/DLWC(C) after verifying the records/documents of contractor for having paid all dues, wages, EPF etc., pertaining to the workers engaged by him. 15.16 If due to any reason whatsoever, Factory management is made liable to pay any liabilities of the contractor under any of the said laws and enactments etc., the Factory management shall recover the same from the dues payable by the Factory to the contractor and /or from the Security Deposit furnished by the contractor with the Factory. 15.17 If the contractor fails to complete the work or any portion thereof as agreed upon or refuses to comply with any directions given to him, the factory management shall initiate action to terminate the contract and forfeit the security deposit. The contractor shall also be liable for any expenses, loss or damage which the factory may incur or sustain by reasons due to contractor’s fault. If it exceeds the amount of security deposit, the same shall be recovered from the dues payable to the contractor. 15.18 Bonus as per the Act to be paid by the contractor to his contract workers. On proof of Bonus disbursement and certified by ALWC(C)/DLWC(C), the same will be reimbursed by HVF management. 16.00 SECURITY CLAUSE : 16.01 Police Verification Report with photograph for each contract worker should be submitted by the contractor within 30 days from the date of commencement of work to prove the credentials of the workers. 16.02 The contractor should submit the list of workers engaged in a particular contract to the security office of HVF before the commencement of the work for issuing of Identity Card. 16.03 Two character certificates duly attested by two different Gazetted officers for each contract worker should be submitted by the contractor to the security office of HVF for issuing of temporary Identity Card. 16.04 Affidavit issued by Notary Public for each worker should also be submitted to the Security Office of HVF by the contractor. 16.05 Police Verification Report (format available with Security Office of HVF) for each worker duly filled in by the contractor is to be submitted by the contractor to the Security Office of HVF along with two passport size photographs for issuing of Identity Card. 16.06 All persons employed by the contractor including the contactor shall possess the Identity card bearing photograph and other particulars while on duty. 16.07 The contractor or his workers should not move around the factory/estate except in the assigned area of work. 16.08 The contractor should not bring any article/material/stores that are not required in connection with the performance of the contract. Contd--21-- --21-16.09 The men/materials /equipments/ vehicles of the contractor is subjected to check by the Factory Management for security reasons. 16.10 If any employee of the contractor is found to commit any misconduct or misbehavior, the Factory at its sole discretion may take suitable action against his worker and will be entitled to restrict such employees from entering the HVF Estate premises. 16.11 Prompt replacement of any personnel whose presence is considered Detrimental to HVF interests is the responsibility of the contractor. as 16.12 All contract employees should have proper dress code for easy identification by indicating the contractor’s symbol. 16.13 The contractor shall be responsible for his employees, observing all the security instructions as issued by the factory from time to time. 16.14 All guest rooms/Offices should be cleaned only in the presence of Contract Supervisor. If any theft or some untoward incident takes place at guest house, during the Contract period, it is the sole responsibility of the Contractor to settle the issue. 16.15 Whenever the contract is terminated or the contract comes to an end, or factory management decides that the contractor should not be allowed to carry out the work herein agreed, in that event, the factory management will be entitled to restrain the contractor from entering the said premises. 16.16 The premises covered in this contract shall continue to be in the possession of the factory and the contractor is only permitted to enter the premises to render services herein mentioned. The contractor shall not have any other rights whatsoever in the above premises. 17.00 SAFETY CLAUSE: 17.01 The contractor should provide safety gadgets, safety instructions and protecting cloths, Safety shoes to his workers and ensure that they do use and wear the same at the time of working without fail. 17.02 The contractor’s men should maintain good personal hygiene and should not suffer from any contagious disease. 17.03 The contractor should take all necessary safety measures at the time of working near electrical overhead /underground cable/equipments and should obtain the clearance from EE(E) section through Y&E section. 17.04 GM/HVF will not be responsible for any loss suffered by the contractor or his men for whatsoever reason. 17.05 Neither the contractor nor his workers shall bring articles like beedi, cigarettes, gas or any articles involving the use of flames or any kind of intoxicant or any item capable of causing fire or any other contraband at the workplace. 18.00 WEEKLY OFF One day weekly off should be given to the Contract Workers without affecting the regular working off the Guest Houses. Contd--22-- --22-19.00 EXTENSION TO THE VALIDITY OF THE CONTRACT OR TERMINATION OF CONTRACT 19.01 General Manager, HVF reserves the rights to terminate or short close the contract without assigning any reason or when the performance is found not satisfactory at the risk and cost of the contractor with one month notice. However in exceptionally grave circumstances, GM HVF reserves the right to cancel the contract without any notice. On his part, the contractor is permitted to terminate the contract by giving minimum three months notice. 19.02 If the contractor fails to complete the work or any portion thereof as agreed upon or refuses to comply with any directions given to him, the factory management shall terminate the contract and forfeit the security deposit. The contractor shall also be liable for any expenses, loss or damage which the factory may incur or sustain by reasons due to contractor’s fault. If it exceeds the amount of security deposit, the same shall be recovered from the dues payable to the contractor. 19.03 General Manager / HVF reserves the right to increase the period of contract by 50 % at the same rate, terms and conditions during the tenure of the contract. But at the same time, contractor is not permitted to demand for any extension. 19.04 The ALWC/DLWC of HVF or any other person authorised on their behalf shall have the powers to make enquiries with a view to ascertaining and enforcing due and proper observance of CL(RA) Act 1970 and other Labour Laws. He shall investigate into any complaints regarding the default made by the Contractor in regard to such provisions. 19.05 The ALWC (C) /DLWC (C) or other person authorized as aforesaid shall submit a report of result of his investigation or enquiry to the General Manager indicating the extent, if any, to which the default has been committed with a note that necessary deduction from the contractor bill be made and the wages and other dues be paid to the labourers concerned. In case, an appeal is made by the contractor to General Manager, actual payment to labourers will be made after General Manager has given his decision on such appeal. 20.00 OBLIGATION OF HVF MANAGEMENT 20.01 The factory management shall render a certificate of satisfactory performance on a monthly basis if everything done by the contractor is found satisfactory. The factory management shall point out the defects and shortcomings in the performance at the time of such defects etc., coming to the notice or mention them in the monthly certificate. 21.00 ARBITRATION Any dispute or differences arising under or out of the contract shall be referred to the sole arbitration of DGOF or any other person appointed by him to act and there should not be any objection to any such appointment that the arbitrator so appointed will be a Govt. servant. The award of the arbitrator shall be final and binding on both the parties. The arbitrator shall be entitled to extend the time of award by the consent of the parties from time to time. The venue of the arbitration will be at the discretion of the arbitrator subject as aforesaid. The Arbitration and Conciliation Act 1996 and the Rules framed there under or any statutory modifications thereof for the time being in force shall be deemed to apply to the arbitration proceedings under this clause. -sd(RAJESH SHARMA) JT.
