Rev. 5/10/13 MACROAIR LIFETIME WARRANTY ON BLADES, HUB AND FRAME MacroAir warrants to the original End-User that MacroAir blades, hub and frame (“Products”) will be free from defects in material and workmanship. For as long as the original End-User owns any MacroAir fan, MacroAir, free of charge, will repair or replace the blades, hub and frame due to any failure or breakage of these stated parts. 1)
The obligation of MacroAir under this warranty is limited to repairing or replacing blades, hub or frame as MacroAir may elect. End-User is responsible for installation of repaired or replaced blades, hub or frame. However, if such repair or replacement is needed within the first year after the Products were originally installed in EndUser’s facility, MacroAir will pay all labor costs up to $250 per breakage or failure event.
Labor costs shall mean costs paid by the End-User to an independent contractor (including an authorized MacroAir dealer, installer, or distributor) employed to remove, dismantle, reassemble or reinstall any of the Products covered by this Lifetime Warranty. In order to receive the benefits of this Lifetime Warranty, the End-User must use the fan in a normal or reasonably anticipated way. This Lifetime Warranty will not cover any failures or breakage of blades, hub or frame caused by (a) failure to properly store the Products before installation; (b) neglect, accident, abuse, misuse, misapplication, or incorrect installation; (c) repair of alteration not authorized in writing by MacroAir personnel or performed by an authorized MacroAir service engineer or agent; (d) improper testing, operation, maintenance, adjustment, or modification of any kind not authorized in writing by MacroAir personnel or performed by an authorized MacroAir customer service engineer or agent; or (e) use of the Products under other than normal operating conditions or in a manner inconsistent with the applicable MacroAir fan labels, instructions, or installation and owners manuals. THE FOREGOING SHALL CONSTITUTE THE SOLE REMEDY OF THE END-USER AND THE SOLE LIABILITY OF MACROAIR WITH REGARD TO THE LIFETIME WARRANTY OF THE BLADES, HUB AND FRAME OF MACROAIR FANS. MACROAIR SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES TO THE END-USER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUE, LOSS OF CAPITAL, COST OF SUBSTITUTION EQUIPMENT, DOWNTIME COST, OR OTHER COSTS NOT EXPRESSLY IN THE WARRANTY LANGUAGE ABOVE.
