Særegne skulpturer og dansk surrealisme ”Jeg har altid haft nok i menneskekroppen” udtalte Erik Thommesen engang om sin kunst. Kroppens anatomi dannede udgangspunkt for den danske billedhugger, men mere som en abstrakt skildring af hvad det vil sige at være menneske end en direkte afbildning. Thommesen fokuserede på det alment eksistentielle, hvilket får hans smukke værker til at fremstå vedkommende også i dag. På årets første auktion i Bredgade er det derfor en stor fornøjelse at kunne præsentere en af de betydeligste private samlinger af Thommesens skulpturer fra 1944-74 – en samling, der giver et rigt indblik i Thommesen homogene produktion. De fleste af de udbudte værker er fremstillet af forskellige former for hårdt træ og vidner om, at kunstneren foretrak at arbejde på gammeldags vis uden elektrisk værktøj. Metoden med sav og stemmejern var tidskrævende, og derfor er hans produktion forholdsvis lille. I dag har Thommesens værker fundet vej til forskellige danske museer, heriblandt Statens Museum for Kunst. Det var ellers en helt anden karriere, der lå i kortene for Thommesen, der som ung læste zoologi på Københavns Universitet. Som kunstner forblev han autodidakt og satte en ære i ikke at lade sig påvirke af tidens kunstretninger, men selvom han søgte uden om det tidstypiske, indgik han i forskellige fællesskaber, kortvarigt med Cobragruppen og gennem 30 år med Martsudstillingen. Arkitekten Finn Juhl spillede også en vigtig rolle, og deres fælles passion for træet som materiale dannede grobund for gensidig inspiration på tværs af kunstarter. Mens Thommesens skulpturer var en del af indretningen i Juhls private hjem i Ordrup, boede Thommesen i et hus, som Juhl havde tegnet. Den udbudte samling stammer fra en af Thommesens andre beundrere, bogtrykker Jørgen Nielsen, og inkluderer to tæpper af hustruen Anna Thommesen, der er studier til hendes udsmykning af alterpartiet i Roskilde Domkirke (kat. nr. 541-553). Menneskekroppen spillede også en afgørende rolle for den danske kunstner Wilhelm Freddie – omend i en noget anden form. Værket ”Nonnens bøn” har med sin titel og de små papirlapper med inskriptionen ”INRI” kristne referencer og tilhører en værkgruppe, der kun sjældent udbydes på markedet. Det blev til i 1937 – samme år, som Freddie afholdt sin skandaleombruste udstilling ”Træk Gaflen ud af Øjet på Sommerfuglen. Sex Surreal”, der under stor mediebevågenhed blev lukket af politiet og medførte, at kunstneren blev dømt for ”offentlig udstilling af utugtigt indhold”. Freddie bekendte sig til den internationale kunstretning surrealismen og frontfiguren André Bretons tanker, hvilket det udbudte værks absurde og underbevidste karakter vidner om (kat.nr. 592). Derudover byder auktionen på Asger Jorns farverige dobbeltmaleri ”Animaux animé(s)” fra 1946, en billedserie af den tyske kunstner Günther Förg og grafik i verdensklasse med Picassos abstraktioner og Andy Warhols berømte portræt af Marilyn Monroe. Vel mødt! Jesper Bruun Rasmussen Distinctive sculptures and Danish Surrealism “The human body has always been enough for me,” Erik Thommesen once said about his art. The work of the Danish sculptor was based on the human anatomy, but more as an abstract depiction of what it means to be human than a direct representation. Thommesen focused on the basic tenets of existentialism, affording his beautiful works relevance to this day. At the first auction of the year at Bredgade, it is therefore our great pleasure to present one of the most important private collections of Thommesen’s sculptures from 1944–74 – a collection that provides a rich insight into his homogeneous production. Most of the works up for auction are made of different kinds of hardwood and testify to the fact that the artist preferred to work in the old-fashioned way without electrical tools. His method, using a saw and chisel, was time consuming, hence his relatively small production. Today, Thommesen’s works have found their way to various Danish museums, including the National Gallery of Denmark. A completely different career had actually been on the cards for Thommesen, who as a young man studied zoology at the University of Copenhagen. He was a self-taught artist who took pride in not being influenced by the art currents of his day. However, despite shunning the norm, he joined various communities – a brief spell with the CoBrA Group and 30 years with Martsudstillingen (the March exhibition). The architect Finn Juhl also played an important role, and their shared passion for wood as a material formed the basis for mutual inspiration across the art forms. While Thommesen’s sculptures adorned Juhl’s private home in Ordrup, Thommesen lived in a house designed by Juhl. The collection up for auction comes from another of Thommesen’s admirers, printer Jørgen Nielsen, and includes two rugs by his wife Anna Thommesen, which are studies for her decoration of the altar in Roskilde Cathedral (cat. no. 541-553). The human body also played a key role in Danish artist Wilhelm Freddie’s work, albeit in a somewhat different form. The work “Nonnens bøn” (the nun’s prayer), with its title and small scraps of paper bearing the inscription “INRI”, has Christian references and belongs to a group of works rarely seen at auction. It was created in 1937 – the same year that Freddie held his scandalous exhibition “Træk Gaflen ud af Øjet på Sommerfuglen. Sex Surreal” (Pull the fork out of the butterfly’s eye. Sex surreal), which was closed by the police under close media attention and led to the artist being convicted of “public exhibition of obscene content”. Freddie subscribed to the international art movement Surrealism and the thinking of its front figure André Breton, which is apparent in the absurd and subconscious nature of the work up for auction (cat.no. 592). In addition, the auction features Asger Jorn’s colourful double painting “Animaux animé(s)” from 1946, a series of paintings by the German artist Günther Förg and world-class graphic art with Picasso’s abstractions and Andy Warhol’s famous portrait of Marilyn Monroe. DKK 125,000 / € 17,000 BRUUN RASMUSSEN BREDGADE AUCTION 854 55 Thommesen – works from printer Jørgen Nielsen’s collection Lot no. 541 - 553 The first international auction of the year at Bredgade promises something quite extraordinary, when we present the most significant private collection of works by the artist couple Erik Thommesen (1916–2008) and Anna Thommesen (1908–2004) ever to be offered to the public at auction – quite possibly a once in a lifetime opportunity. These are works of a consistent quality, from different periods and in different materials. The collection, which was established in the period from around 1960 to 1975, comes from printer Jørgen Nielsen, one of the few private collectors in the period to appreciate the Thommesen’s unique artistic qualities. Nielsen’s meeting with Erik and Anna Thommesen developed into a lifelong passion, a close friendship and an ongoing dialogue, which meant that he often spent days at a time in the couple’s company and regularly purchased their works. In the catalogue, we have been able to reproduce some of Jørgen Nielsen’s private photographs – a photo­­graphic record of the Thommesen’s house and studio in the early 1970s. Interestingly enough, a house designed by another early admirer of Erik Thommesen’s sculptures in particular, furniture designer Finn Juhl (1912–1989), who liked to exhibit his own pieces with Thommesen’s sculptures, and also adorned his own home and his design studio with them. This artistic kinship across and in spite of art forms – function versus non-function – seems obvious today. Both explore the potential and the resilience of the wood. A sense of something organic and vital exists in both their works. When he was active, Finn Juhl experienced sliding in and out of an international public’s awareness, and, in addition, interest in his furniture has seen a dramatic revival in recent years. One could certainly wish the same for Erik Thommesen’s works – and not least the public at large – as, both in their day and now, the works possess a unique expression and presence. Several important historical references can be linked to Erik Thommesen’s works, including his relationship to the CoBrA group. A relationship which, according to Thommesen aficionado Henning Jørgensen, was neither profound nor peripheral. Erik Thommesen himself considered CoBrA a “semblance of a group, a superficial phenomenon that emanated from Asger Jorn’s enterprise”. Erik Thommesen’s main exhibition context was, however, the undogmatic Martsudstilling (March exhibition), which he – and Ejler Bille among others – initiated in 1951, and where he exhibited over the next 30 years. Erik Thommesen’s works are unschooled and not an extension of any specific tradition or specific models. They are about the human form and the basic tenets of existentialism. The works up for auction, which date from 1944 to 1974, testify to an outstandingly rigorous and homogeneous production. The tone of Erik Thommesen’s sculptures resonates in Anna Thommesen’s geometric carpets, although the works could hardly be more different. From an equally self-taught background, she went on to receive commissions for major official decorating assignments, including for the New Carlsberg Foundation and the Danish Arts Foundation. The two carpets in Jørgen Nielsen’s collection are studies for her most high-profile assignment: the decoration of the altar in Roskilde Cathedral (1974–77). Anna Thommesen’s carpets are abstract, but with nature and its colour tones at their core, right into the material – the yarn – which, from the outset, she even dyed herself using plant extracts. A working process in which she was always in charge of herself - from the sketch to colouring of the yarn and finally the weaving.The inspiration in her geometric and always doubble- symmetric rugs, seems to be based on the ethnic, South American art of textile. However the actural inspiration and colour composition comes from the nordic colour- and nature impressions that also appear in the work of her husband, Erik Thommesen. The work up for auction lends meaning to the phrase "two sides of the same coin", given the rather unusual nature of it: it actually consists of two evenly matched paintings, painted within six months of each other. Both motifs are listed with independent reference numbers in Guy Atkins' catalogue, and the canvas is beautifully framed, so the choice of painting on display is entirely optional - neither motif plays second fiddle to the other. The earlier of the two (Atkins no. 435) was painted in Dragør where, in the winter of 1946, Asger Jorn borrowed his friend, architect and art collector, Robert Dahlmann Olsen's house. The later work was probably painted on the island of Orust, north of Gothenburg, where Jorn visited his Swedish colleague Nils Wedel (1897-1967) in the summer of 1946. The colourful creatures in the earlier painting hark back to the bird figures in love of the Didaska paintings, while the rhythmic drawing with its marked contours and organic lines in both works points towards the denser compositions of Jorn's later production. It was probably painted at the end of 1933 and finished early in January 1934 in time for the exhibition later in January 1934. It is a flat picture without any perspective. It is a work the composition and colours of which are clearly influenced by Joan Miro but also by Vasily Kandinsky and Paul Klee. Apart from these influences he has included symbols in the elements of the painting. These symbols are of a surrealistic nature. The painting requires the beholder to form his/her own opinion. The painting consists of outer and inner properties. The outer property is what you see, forms, colours, lines, symbols and the interaction between them. The inner property is the analysis each beholder forms by looking at the painting. The question as to how a beholder perceives a painting, not only in relation to an artist’s theory or explanation, but just as much by looking at it, is interesting because a person’s associative perception of an abstract-surrealistic painting is free and therefore interpretations may be legio. This may also explain why beholders are hesitant to describe and analyse an abstract-surrealistic painting. Educated at the Art Academy in Oslo, Norway and at Bauhaus, Dessau, in Germany where he was pupil during the winter term 1930/31. Among his teachers were Vassili Kandinsky and Paul Klee. From 1932 he worked with fellow artists Richard S. Mortensen and Ejler Bille. In 1933 he published the book “symbols in abstract art”. They formed the group “The Line”, published a periodical of the same name and organised the exhibition in January 1934. After publication of his book “surrealism” in the autumn of 1934 the group broke up and Vilhelm Bjerke Petersen joined forces with other surrealistic artists. The break meant that Richard Mortensen and Ejler Bille took over the periodical The Line whereas Vilhelm Bjerke Petersen took over the exhibition activities. He continued with these activities and arranged an international exhibition, cubism - surrealism, (kubisme - surrealisme) with an introduction by André Breton and the participation of a number of surrealists from France, the Group Gravitations, Danish and Norwegian artists and the Swedish Halmstad Group of surrealistic artists in January 1935. The selection of the surrealists from France was taken care of by André Breton, Max Ernst (1891 - 1976) and the Swedish painter Erik Olson (1901-1986), who at that time lived in Paris. It is interesting that most of the surrealists from France were not French, only Valentine Hugo (1887-1968), Marie-Berthe Ernst (1910- ) and Yves Tanguy (1900-1955) were French, whereas most of Group Gravitations were French. The painting “Nonnens bøn” (The nun’s prayer) belongs to an exclusive group of works and a period in Wilhelm Freddie’s production which only very rarely comes up for auction. 1937 was the year of Wilhelm Freddie’s much talked about scandalous exhibition “Træk Gaflen ud af Øjet på Sommerfuglen. Sex Surreal” (Pull the fork out of the eye of the butterfly. Sex Surreal) at Ole Haslunds Hus in Copenhagen, which, under close media attention, was closed by police. The works were confiscated and the artist was sentenced to mitigated imprisonment for the public exhibition of obscene content. Wilhelm Freddie’s name was thus catapulted into broader public awareness in Denmark, but more as a result of the scandal than his art. Many years would pass before he won his rightful place in Danish art history as a pioneer of surrealism. From the early 1930s, Freddie was well informed about international Surrealism and the thinking of its chief ideologist André Breton, a fact echoed in the artist’s remarks to the daily newspaper B.T. in 1931, when he publicly links himself to Surrealism for the first time: “[My art] is based on the theory that the subconscious, dreams and instincts are the only constants in human existence (...). Surrealism is, it’s an over-realism that simply denies the outer reality, which is a delusion, and leads the focal point to the inner reality” (quoted from Dorthe Aagesen pages 23–24 in the above mentioned book). In the painting “Nonnens bøn” (The nun’s prayer), an amorphous, chained figure with its back to us is seen growing up out of the ground and into a mysterious, partly indefinable space. Attached all over the figure’s body are notes with the initials INRI – the Latin inscription on Jesus’ cross: Iesus Nazarenus Rex Iudaeorum (Jesus of Nazareth, King of the Jews). In Wilhelm Freddie’s artistic avant-garde project, no established norms or institutions are spared. The photograph from Wilhelm Freddie’s archive shows the artist posing in front of the painting in a previous state, where the figure is placed in a deep landscape-like space. Monumental paintings from Kurt Trampedach's New Yorker years are something of a rarity on the Danish art market, as the majority of these works are exhibited and sold through Allan Stone Gallery in New York.  "Jeg gik mig over sø og land" (I travelled over sea and land) refers quite literally to the shift in Kurt Trampedach's life and art which occurred around the time of his move to the French Basque Country in 1980, and as a result of the even greater distance he placed between himself and Denmark when he left for New York in 1983. His paintings of that period - this one included - mark a new start in Trampedach's career - mentally, motif-wise and in terms of his use of colour, which now becomes intense and glowing. The work up for auction offers a double vision, with a physical effect on the beholder due to its sizable dimensions. In the depth (and looked at from a distance) is a retrospective, thoughtful character, who insistently seeks the beholder's gaze over his shoulder. In the foreground (seen close up) figure and architecture studies as well as texts with reference to the artist's new surroundings and world of motifs in the Basque Country appear: the house in Sare (Sara), the mountain La Rhune (Larrun), New [York], animals and people. Signed v.b.-p.-45. Oil on masonite. 46 x 55 cm. Vilhelm Bjerke Petersen fled with his family to Sweden on a boat in the early morning of April 17th 1944. After the war Vilhelm Bjerke Petersen stayed on in Sweden until he died in 1957, apart from a stay in New York in 1946/47. The painting was painted in Sweden sometime in 1945, possibly before May 1945. The painting is divided into two parts horizontally, a smaller light inviting landscape above and a larger black underground area with eight human beings drawn in white lines below; plants are growing in the black area and from the human beings and a butterfly can be seen as well. As the human beings, they are also drawn in white lines. This way to paint may be inspired by Max Ernst, who in the twenties created black paintings with figures drawn in white lines. He was affiliated with the groups Le Nouveau Réalisme and particularly the Fluxus movement in the 60s, where he remained one of the leading artists until his death in 1977. His art was tachist. Later he painted rebus paintings and “reading works”, works, which were to involve the beholder. His garbage sculptures were made of all manner of materials that he found. He also participated in a number of important Fluxus happenings over the years. From 1960-1968, he was a member of Majudstillingen, a group of Danish artists. The idea for the sculpture is born on a street somewhere in the former Yugoslavia in 2002, where the artist Marco Evaristti sees a little girl, who makes a big impression on him. The girl is missing an arm and a leg. She is pregnant and no more than 13 years old. A bus drives passed her, and the girl gives the bus the finger. The artist gets the feeling that the girl is very proud despite the circumstances of her life. He does not talk to the girl, but believes her to be a mine victim. In 2004, the sculpture was part of Folkekirkens Nødhjælp's (DanChurchAid) mine clearing campaign 'Lars og Lone rydder Albanien' (Lars and Lone to clear Albania). The artist donated his proceeds from the sale of the bronze sculpture, and on the same occasion Politikens Galleri released 30 cm high casts of the sculpture. The auction presents material from the Spanish Civil War, the war that formed the notable carrier for the most renowned war photographer of all time, Robert Capa (1913-1954). Capa went to Spain to cover the Spanish Civil War in 1936 along with his colleague David ‘Chim’ Seymour (1911-1956) and his lover and colleague Gerda Taro (1910-1937). Taro gave her life to this mission, when she was killed by a runaway tank in 1937. FORTRYDELSESRET For privatkøb af emner på en online-auktion gælder loven om fjernsalg, herunder også 14 dages fortrydelsesret. Eventuelle omkostninger forbundet med transport af købte emner retur fra køber, betales af køber selv. Såfremt køber benytter sig af sin fortrydelsesret, refunderer Bruun Rasmussen betalingen umiddelbart efter, at varen er sendt retur og modtaget af Bruun Rasmussen. Bruun Rasmussen gør opmærksom på, at det herefter er op til bankerne/kreditkortselskaberne, hvornår refusionen indgår på købers konto. § 2. BETALING § 4. AFGIFTSFRITAGELSE Ved køb på alle net-auktioner tillægges hammerslagsprisen 25%, der dækker salær på 20% samt moms af salæret. Ved køb på alle traditionelle auktioner tillægges hammerslagsprisen 30% (for vin, mønter og frimærker 25%), der dækker salær på 24% samt moms af salæret. Visse numre handles efter særlige regler til fuldmoms, så udover auktionsomkostninger på 24% (for net-auktioner, vin, mønter og frimærker dog 20%), beregnes moms på 25% af både hammerslag og auktionsomkostninger. Disse numre er mærket med en stjerne (*). Danske momsregistrerede købere skal overfor Bruun Rasmussen oplyse deres SE-/CVR-nr. (moms-nr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms. For visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. § 4. Afgiftsfritagelse omfatter ikke EU private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter. Købesummen forfalder til betaling ved tilslaget. Der kan betales kontant op til DKK 50.000 eller med Dankort, banknoteret check, rejsechecks, Visa-, Master-, Diners Club- eller Eurocard. Personlige udenlandske checks kan kun anvendes efter forudgående aftale. På de traditionelle auktioner i Bredgade skal betaling af købte emner finde sted under eller umiddelbart efter auktionen og under alle omstændigheder senest 8 dage efter fakturadatoen. På net-auktionerne trækkes købesummen automatisk på det af kunden oplyste betalings-/kreditkort i forbindelse med, at det købte emne udtages til transport (ca. 12 timer efter dagens salg). Samtidig tilsendes køber faktura og transportoplysninger. Betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned. Betales købesum og renter ikke inden 8 dage efter at Bruun Rasmussen har afsendt påkrav herom til køber, er Bruun Rasmussen berettiget til at annullere købet og bortsælge det købte på ny auktion hos Bruun Rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. Et eventuelt overskud tilfalder den, der har indleveret det købte til auktion. Har den misligholdende køber tilgodehavender fra salg af effekter hos Bruun Rasmussen, er Bruun Rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning. Har den misligholdende køber indleveret andre effekter til salg, er Bruun Rasmussen berettiget til at bortsælge sådanne effekter Udenlandske købere, der opfylder nedennævnte betingelser, betaler henholdsvis 24% i auktionsomkostninger af hammerslaget på traditional auktion og 20% i auktionsomkostninger af hammerslaget på net-auktion, og bliver ikke belastet af danske afgifter. A. Købere med bopæl i et andet EU-land: Købere, som er momsregistreret i et andet EU-land, fritages for at betale dansk moms, når momsregistreringen dokumenteres over for Bruun Rasmussen, som skal påføre momsnummeret på fakturaen. B. Købere med bopæl uden for EU: 1. Forsendelse gennem speditør: Effekter, der eksporteres gennem en af Bruun Rasmussen godkendt speditør, fritages for afgift. 2. Udførsel som rejsegods: Der kan ske fritagelse for dansk afgift, når køberen selv medtager det købte under forudsætning af, at følgende betingelser er opfyldt: Fakturaen skal være betalt, og den danske afgift på 25% af fakturabeløbet skal være deponeret hos Bruun Rasmussen. a. Købere med fast bopæl i Norge vil få den danske moms refunderet, så snart Bruun Rasmussen har modtaget købsfakturaen retur med påtegning om officiel indførsel fra det endelige lands toldmyndighed eller anden på omsætnings-afgiftsområdet kompetent myndighed, hvis købet overstiger DKK 1.200. b. Købere med fast bopæl andre steder uden for EU vil få den danske moms refunderet, efter at effekterne har været forevist til toldbehandling i forbindelse med køberens udrejse fra EU. Eksportørblanketten returneres til Bruun Rasmussen efter at være forsynet med et toldvæsens attest for udførslen, hvis købet overstiger DKK 300. Dette gælder også for Færøerne og Grønland. 246 § 5. AFGIFTSBETALING A. Momsregistrerede i andre EU-lande, der ikke ønsker at gøre brug af § 4, kan i stedet vælge at handle til brugtmoms/fuldmoms på lige fod med private købere. Dette skal meddeles Bruun Rasmussen inden kl. 10 den følgende auktionsdag. B. Momsregistrerede i Danmark kan vælge at købe til fuldmoms med 25% af både hammerslag og auktionsomkostninger. Det købte henligger fra hammerslaget for købers regning og risiko. For varer, der ikke afhentes ifølge aftale efter hammerslaget, vil blive kørt på fjernlager på købers regning og risiko. Købte varer, der er betalt, men ikke afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden. § 7. FORSENDELSE Såfremt Bruun Rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers regning og risiko. Bruun Rasmussen kan således ikke drages til ansvar for skader forvoldt på købte varer under forsendelse eller for forsvundne forsendelser. § 8. KUNSTNERAFGIFT TIL COPY-DA N CD Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag for værker af nyere danske og visse udenlandske kunstnere, som enten er nulevende eller ikke har været døde i mere end 70 år. Følgeretsvederlaget opkræves af Bruun Rasmussen på vegne af kunstnernes organisation Copydan. Disse værker er mærket (CD) for Copydan ud for katalognummeret. Den såkaldte Copydan-afgift tillægges hammerslagsprisen inkl. salær, når beløbet overstiger €300. Copydan-afgiften er: • 5% af den del af hammerslagsprisen og salæret (ekskl. moms), der udgør indtil €50.000. • 3% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem €50.000 og €200.000. • 1% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem €200.000 og €350.000. • 0,5% af den del af hammerslagsslagsprisen (ekskl. moms), der ligger mellem €350.000 og €500.000. • 0,25% af den del af hammerslagsprisen (ekskl. moms), der ligger over €500.000. Copydan-afgiften kan ikke overstige €12.500 for det enkelte kunstværk. Euro-kursen er fastsat af Copydan i 2015 til kurs 744,01 pr. €100. Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt beskrivelsen har været behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt beskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter den samlede erlagte købesum tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber. Væsentlige fejl i beskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen. Retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte den pågældende effekt hos Bruun Rasmussen og er betinget af, at krav om annullering fremsættes skriftligt over for Bruun Rasmussen inden 2 år efter købsdagen, og af at det købte inden samme frist returneres til Bruun Rasmussen i den samme stand i enhver henseende, som det købte var i på hammerslagstidspunktet. Køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste, dækket. Et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt: a. beskrivelsen i katalog eller på hjemmesiden på hammerslagsdagen var i overensstemmelse med den på dette tidspunkt gældende opfattelse blandt lærde og eksperter. b. den eneste måde til på salgstidspunktet at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter salgstidspunktet, eller som ville have været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den pågældende effekt. I tillæg til ovenstående frist gælder de almindelige forældelsesregler i forældelsesloven, efter hvilke køber ikke under nogen omstændigheder kan gøre noget krav gældende over for Bruun Rasmussen, når der er forløbet mere end 5 år fra købsdagen. Gives eksporttilladelse ikke, er Kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet bliver hævet for køber. § 10. BESKRIVELSE AF EMNER Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i katalog eller hjemmeside med senere offentliggjorte ændringer og modifikationer. Beskrivelsen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper. De solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl, mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i katalog eller på hjemmesiden. Afbildninger i katalog eller på hjemmesiden er blot til identifikation og kan ikke anvendes til vurdering af effekternes stand. Enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn forvisse sig om de ønskede effekters stand. Beskrivelsen er udtryk for den på salgstidspunktet blandt lærde og eksperter herskende opfattelse. Det tilrådes at søge oplysning hos de lokale myndigheder. 247 CONDITIONS OF PURCHASE § 1. BIDDING The buyer shall be the highest bidder at the “hammer price”. Any person bidding on behalf of a third party shall be liable in surety for completion of the sale. At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter, fax or the homepage direct telephone bids or the homepage, should be able to document their ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to refuse to accept a bid if, when requested, adequate security or adequate payment on account has not been rendered. Bids should be made by the bidder in person at the place of auction or by written commission by letter, fax or the homepage. For online auctions alle bids are submitted via the homepage. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding. Credit/debit card information must be registered with Bruun Rasmussen before bids can be submitted. § 2. PAYMENT Purchases made at all Bruun Rasmussen online auctions are subject to a 25% fee, which covers 20% buyer’s premium and VAT of the premium. Purchases made at all Bruun Rasmussen traditional salesroom auctions are subject to a 30% fee (for wines, coins and stamps 25%), which covers 24% buyer’s premium plus VAT of the premium. Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter called normal VAT), so that the purchase price is the hammer price plus an additional 24% (for online auctions, wines, coins and stamps 20%) in buyer’s premium and VAT of 25% levied on both the hammer price and the buyer’s premium. VAT-exemption does not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish legislation on Special VAT Scheme for Sales of Works of Art, Collectors’items and Antiques by Public Auction). The purchase price falls due for payment when the goods have been knocked down. Payment may be made in cash up to DKK 50,000, by Dankort, banker’s cheque, traveller’s cheque, Visa-, Master-, Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement. At traditional auctions payment for purchased items must be made during or immediately after the auction. Under all circumstances payment must be made no later than eight days from the date of the invoice. With online auctions, payment automatically takes place when the items are prepared for dispatch (circa 12 hours after the purchase has been made) using the credit/ debit card details submitted by the purchaser. At the same time an invoice and dispatch information will be sent to the purchaser. Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be charged. If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction. If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer. 248 If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell such goods at a Bruun Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value of such goods may be deemed to exceed the debt payable. Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaserr. § 3. MONEY-BACK GUARANTEE Online purchase of items by private individuals is subject to Danish consumer law, which extends 14 days of money-back guarantee. The purchaser is liable for any costs related to the transport of returned items. Should a purchaser seek to avail himself or herself of the moneyback guarantee, Bruun Rasmussen will refund the payment on receiving the returned items. Please note that the date on which accounts are debited is subject to the policy of the purchaser’s bank/credit card company. § 4. EXEMPTION FROM VAT International purchasers, who fulfill the conditions stipulated below, must pay a fee of 24% of the auction price at traditional salesroom auctions and a 20% fee of auction prices for items purchased online. They are exempt from the payment of Danish VAT.: A. Buyers residing in another EU Member State: Buyers are exempt from paying Danish VAT as long as they have provided Bruun Rasmussen with documentation of their VAT registration. The VAT number will then be quoted on Bruun Rasmussen’s invoice. B. Buyers residing outside the EU: 1 Dispatch through forwarding agent: Lots exported through a forwarding agent approved by Bruun Rasmussen are exempt from VAT. 2 Export as personal luggage: Goods may be exempt from Danish VAT when the buyer personally takes the goods out of the country as luggage, provided the following conditions have been met: The invoice must have been paid and the Danish duty of 25% of the invoice amount must have been deposited with Bruun Rasmussen. a Buyers residing in Norway will be refunded the Danish VAT as soon as the invoice of sale has been returned to Bruun Rasmussen endorsed by the customs authorities of the country in question or by any other authority with jurisdiction over matters of purchase tax with respect to official imports of goods into the country in question if the purchase price exceeds DKK 1,200. b Buyers residing in other countries outside the EU will be refunded the Danish VAT after the goods have been presented for customs clearance in connection with the departure of the buyer from the EU. The exporter’s form should be returned to Bruun Rasmussen after being endorsed with the customs authorities’export certificate if the purchase price exceeds DKK 300 This also applies to the Faroe Islands and Greenland. § 5. PAYMENT OF TAXES AND DUTIES A. Buyers with VAT-registration in other EU member states who do not wish to make use of Article 3 may instead choose to purchase items subject to Special VAT/Normal VAT in the same manner as private buyers. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. B. Buyers with VAT-registration in Denmark may choose to purchase subject to Normal VAT at 25% of the hammer price plus premium. Bruun Rasmussen must be notified of this before 10 a.m. on the following auction day. BRUUN RASMUSSEN BREDGADE AUCTION 854 § 6. COLLECTION OF PURCHASES The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held at the buyer’s own expense and risk. A storage fee will be charged for lots which have not been collected according to agreement. Lots which have been paid for but not collected will be storaged at buyers expense. Lots not collected within 1 year will be resold at auction or privately at the buyer’s expense. § 7. DISPATCH Should Bruun Rasmussen undertake the packaging and forwarding of purchased goods, this shall be done at the buyer’s own expense and risk. Bruun Rasmussen shall thus not be held liable neither for any damage caused to purchased goods during dispatch nor for any missing consignments. § 8. DROIT DE SUITE In accordance with Danish copyright law, an additional royalty fee is to be paid for the purchase of works by contemporary Danish artist and some international artists who are either still alive or who have been dead for less than 70 years. The additional royalty fee will be collected by Bruun Rasmussen on behalf of Copydan, which is a Danish-based joint collecting society. Such works are marked with (CD) for Copydan next to the lot number. The Copydan royalty fee is added to the auction price including the buyer’s premium when the total exceeds €300. Copydan royalty fees: • 5% of the auction price and buyer’s premium (excluding VAT) totalling up to €50,000. • 3% of the auction price and buyer’s premium (excluding VAT) of totals between €50,000 and €200,000. • 1% of the auction price and buyer’s premium (excluding VAT) of totals between €200,000 and €350,000. • 0.5% of the auction price and buyer’s premium (excluding VAT) of totals between €350,000 and €500,000. • 0.25% of the auction price and buyer’s premium (excluding VAT) of totals above €500,000. Copydan royalties must not exceed €12,500 for an individual artwork. The euro exchange rate has been set by Copydan for 2015 at DKK 744,01 per €100. arise after the purchase regarding the genuineness of the purchased lot or its conformance with the description, Bruun Rasmussen should immediately be informed thereof. Should the purchased lot be proved to be a forgery, or if the description contains material errors which lead to a considerably higher hammer price than that which a correct description would presumably result in, the buyer shall be entitled to cancel the purchase, after which the buyer shall be reimbursed for the total purchase price paid plus buyer’s premium and VAT, when applicable. For material errors in the description in respect to measurements or weight, compensation shall only be paid on a percentage basis in proportion to the difference. The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition in any and all respects which the purchased lot was in at the time of the lot being knocked down to the buyer. In the event of cancellation the buyer shall not be entitled to claim payment of interest on the purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss incurred, including any possible loss of profit in connection with reselling. It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if: a the description on the day the lot was knocked down to the buyer was in accordance with the then generally accepted opinion of scholars and experts; b the only way of establishing whether the lot was a forgery at the time of the sale was the implementation of scientific processes, the validity of which was only acknowledged after the time of the sale, or which would have required a disproportionate amount of cost, or which would have been impossible to carry out without damaging the lot in question. In addition to the time-limits stated above, all purchases are subject to the Statute of Limitations stipulated by danish law by which Bruun Rasmussen is under no circumstance liable for purchases after 5 years from the date of purchase. EXPORT LICENCE COMMISSION Applications for an export licence must be made to the Danish Cultural Assets Committee when required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen on behalf of the buyer, now that the price is known. Should an export licence not be granted, the Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase price, and the buyer would thus not be bound to the purchase. Bruun Rasmussen undertakes to execute commission bids for bidders who are unable to be present at the auction. It is a prerequisite that Bruun Rasmussen receives the commissions by letter, fax or telephone 24 hours before the start of the auction for the bidders’ credit to be checked, if necessary.
