Acceptance: a) Any tender may be rejected or accepted in whole or in part. b) The lowest or any tender will not necessarily be accepted. c) This offer shall remain open for acceptance for a period of not less than 90 days from closing date of tender.

Prices: a) Prices include packaging, cartage and loading charges unless otherwise specified in tender. b) Prices quoted shall be considered net unless cash discounts are specified. c) Prices are FOB Central Regional Health Authority site specific. d) Discounts offered will be deducted when payment is made.

Facsimile Bids or amendment to proposals previously submitted will not be accepted by the Central Regional Health Authority.

Products: a) All offered products should be fully described by name of manufacturer and product code. b) Bidders are responsible for indicating products that are latex free and scent free. Preference will be given to products that are latex free and scent free.
5.
Delivery: a) Deliveries must be made in accordance with dates stated on Purchase Orders. b) All shipments must be properly packaged to avoid breakage or spoilage. c) Delivery can be on an Aas required@ basis by the hospital or individual Purchase Order. d) All delivery slips and invoices must state Purchase Order Number.

Invoicing: a) Invoices will be submitted directly to the Central Regional Health Authority.

Warranty: a) The vendor guarantees all equipment, materials, workmanship and laborers items. b) The vendor warrants title to commodities supplied and warrants them free from defect and/or imperfections and will indemnify and hold purchaser nameless against any or all suits, claims, demands, and/or expenses, patent, litigation, infringement, or any claim by third parties in or to the commodities mentioned and supplied by the vendor.

Inspection: a) All goods delivered are subject to inspections and test within a reasonable time after delivery at purchaser’s premises.

Returns: a) In the event of a defective product, The Central Regional Health Authority reserves the right to return it to the supplier for full credit, notwithstanding intermediate payment by the purchaser.

Compliance with Laws: a) The vendor shall be responsible for complying with all Federal, Provincial, and Municipal laws, rules and regulations applicable to the sale of the contract material. b) Compliance with regulation Pharmaceutical Contracts Manufacturing companies and their products shall conform and abide with the Drug Quality Assessment Program (HPS), Canadian Government Specifications Board Standards 74-GP-1, Narcotic Control Act, Food and Drug Act.

Tender submission form must be completed and signed detailing the bid price submitted. Failure to complete this form will result in bid disqualification.
Central Health will receive Tenders up to and including 2:00 PM NL Time on Thursday, September 7, 2017 for supply only of 7units of Combination Ovens at 6 locations as identified. 1.0
General Provisions 1.1
Intent To Supply Combination Ovens to locations as identified in the attached specification.
1.2
Client Background Central Health was established in 2005 and is responsible for the delivery of Health and Community Services in the Central Region.
1.3
Vendor Response 1.3.1 Vendor’s tender must contain an Executive Summary which shall contain: a.
A brief description of the product being quoted.
b.
The name, title and address of the Vendor’s representative responsible for the preparation of the Tender.
1.3.2 All prices quoted for goods and services must be specified in Canadian dollars, FOB Sites. All Tenders will be held to be valid for ninety (90) days following the Tender closing date. 1.3.3 Tenders must be received in full on or before the exact closing time and date indicated. TENDERS RECEIVED AFTER THAT TIME WILL NOT BE CONSIDERED. 1.3.4 All costs relating to the work and materials supplied by the Vendor in responding to this Invitation to Tender must be borne by the Vendor.

1.5.6 The awarded pricing on this contract will be considered a standing offer for a Two (2) year period from date of award. 1.5.7 Do not include applicable taxes in price. Bid prices must show taxes extra. 1.5.8 Products quoted must be approved by Central Health before award.

Warranty 1.6.1 The Vendor shall warrant that the product supplied to Central Health shall equal the published specifications.
1.6.2 The Vendor shall provide no less than a 1-year warranty on products. The Vendor agrees to provide free of charge all parts and labour necessary to repair the system during the first year of operation. 1.6.3 The warranty start date will be after receipt and units are fully functional for daily usage. 1.6.4 Vendor shall indicate the individual who will be providing the service and the nearest service location.

GENERAL GENERAL REQUIREMENTS AND PURPOSE .1
The General Conditions of this Contract, of these Specifications are a part of this Section and shall apply here.

This specification has been prepared for the purchase of the supply, delivery, setting in place, installation coordination, start up, operational training, service training and support of combination (Combi) ovens for the following Central Health facilities: Bonnews Lodge, Badgers Quay (1 unit) Central NL Regional Health Centre, Grand Falls (2 units) Dr. Hugh Twomey Health Centre, Botwood (1 unit) James Paton Memorial Hospital, Gander (1 unit) Lakeside Homes, Gander (1 unit) Valley Vista Seniors Complex (1 unit)

The intent of this specification is for Central Health Newfoundland (CH) to enter into a partnership with a Combi oven manufacturer that best identifies the total cost and management of ownership including on site training for the front-line staff and management who will operate the oven as well as short term and long term training for the CH maintenance team.

The same unit, terms and conditions of this contract are to remain available and valid for two (2) years to CH as well as all Newfoundland Health Boards for the purchase of the same model Combi Oven.
RELATED WORK
1.2.1
WORK PROVIDED BY OWNER (ELECTRICAL) .1
Supply, rough-in, installation and connection of all necessary electrical wiring and conduit required for the operation of Food Service Equipment, unless otherwise stated in Part 1.3 and 2 of this Specification.

Supply and installation of wiring from the building source or distribution point of power, through disconnect switches, starters to the terminals, connection box, circuit breaker panel or plug receptacles located on the equipment. Equipment manufacturer's control panels and switches are not considered to be a disconnect switch unless specifically permitted by applicable codes.

Disconnect and connect all existing food service equipment where required.
WORK PROVIDED BY OWNER (PLUMBING) .1
Supply, rough-in, installation and connection of all water, drain, vent, as per code requirements from building supply to the point of connection required for the complete operation of the Foodservice Equipment.

Indirect drain lines t funnel drain at a rate of not less than 45mm per 1000mm. Condensate drain lines from refrigerator or freezer evaporator coils to be trapped.

1.3.1
Work listed here under includes but is not limited to the provision of all specified equipment indicated on the drawings and specifications together with labour, material, tools, plant, delivery, uncrating, setting in place of equipment, leveling cleaning herein, ready for final connection of services by mechanical and electrical trades.
ELECTRICAL BY FEC .1
Supply and installation of all internal wiring in a concealed and well supported manner and terminated inside circuit breaker panels or junction boxes ready for final connection by the electrical trades. All equipment shall be inspected by the local hydro authority and carry CSA approval.

MISCELLANEOUS BY FEC .1
Protection, identification and recessing of all controls, pilot lights, switches and valves on any item of equipment.

Provision of all necessary access panels within each piece of equipment to allow for proper maintenance and service. Allow access when 2 or more units are adjacent to each other.

Supply of all standard equipment accessories normally furnished with all items specified whether indicated or not.

Provision of all inserts, bolts, anchors, sleeves, ferrules and other assorted hardware as may be necessary for the proper anchorage, fixing or attachment of equipment to the building.

Verification of the dimensions and services of all pieces of equipment that may be supplied by Others but are to become a part of the equipment layout as illustrated and specified this tender in order to ensure a proper fit and coordinated installation.
QUALITY ASSURANCE .1
The work of this section shall be executed by a Foodservice Equipment Contractor with capable plant, engineering, supervisory personnel, and experience in foodservice equipment supply and installation. Contractor to have a minimum of five (5) years’ experience. Provide, if requested, references to substantiate recent work of similar type, size and quality to that specified herein.

If the Foodservice Equipment Contractor is an equipment dealer only, he shall at the time of tendering, in writing provide the name, address and qualifications of the contractor proposed for the installation of equipment and contract execution.

All equipment and components supplied from manufacturers shall be the latest model or issue and shall be new and unused in every respect.
CERTIFICATES OF APPROVAL .1
Conform to all laws, bylaws, rules, regulations, and requirements of all authorities having jurisdiction.

All electrical equipment must conform to the Canadian Hydro Electrical Code, the Electrical Inspection Department Bulletins, the NL. Hydro Electric Safety Code and the Canadian Standards Association. All equipment must have a C.S.A. approval label. Equipment that is not C.S.A. approved will be rejected, removed from the site and substituted for at no additional cost to the Contract.

Any plumbing or drainage systems shall conform to the local Plumbing Code and relevant provincial Water Resources Act except as modified by regulations and bylaws of authorities having jurisdiction.

Each piece of equipment shall be accompanied by a label or certificate of approval.

Equipment design and fabrication must conform with the National Sanitation Foundation and Provincial as well as Local Municipal Health Department Regulations.
SHOP DRAWINGS .1
Refer to General Requirements as stated in this tender document.

All fabricated items and assemblies of equipment shall be completely illustrated by shop drawings with a detailed description, clearly indicated methods of construction, gauges, assembly, fastenings, services, etc.

Drawings prepared by the Consultant depict equipment design and details. It is the responsibility of the Foodservice Equipment / Refrigeration Contractor to prepare shop drawings in conjunction with the Consultants' drawings, specifications, mechanical and electrical data, details and other information. Co ordinate drawings with as built site conditions and the work of the owners forces.

Ensure that all component parts and assemblies of each piece of equipment will support the loads anticipated without defection detrimental to function, safety or appearance.

Prepare shop drawings on the same size sheet as plans and elevations, in a scale of not less than 1:50 for plans; details and sections in 1:20 scale to clearly illustrate the construction and arrangement of equipment.

Prepare fully dimensioned "Roughing In" and final connection point drawings for mechanical (plumbing) and electrical services. Separate mechanical and electrical, or combined drawings, may be submitted. In either case, drawings must be a minimum of 1:50 scale. Include refrigeration schematics and any pertinent installation diagrams including dimensioned "sleeving" drawing.

Verify the power and location requirements for any piece of equipment that is being supplied by the Owner or is existing and being reused. Incorporate this information into the shop drawings, "rough in" and "connection point" drawings.

Base, curb and depression drawings including low walls, cut outs and openings must be fully dimensioned and drawn at 1:50 scale.

CATALOGUE CUTS & ILLUSTRATIONS .1
All manufactured items being purchased by the must be illustrated by catalogue cuts and data sheets.

Provide in PDF illustration/cuts formatted in booklet form for review or equivalent electronic documentation. Sheets are to be in numerical order, properly labelled with the name of the project and accompanied by a lead sheet with an itemized list of contents. The lead sheet is to include the make, model, accessories, electrical and mechanical requirements of the item it is describing.

Ensure that the equipment suits the space allocations and the intent of the design.

After the illustrations have been reviewed, provide the required number of printed sets for distribution as required by the owner. Electronic submissions will be accepted if approved by the owner’s representative.

SCOPE AND TERM OF CONTRACT .1

The successful bidder will agree to also make this product available to the remaining Newfoundland Health Boards under the same terms and conditions as Central Health. These Health Boards include, Labrador Grenfell, Western and Eastern as well as any additional purchases by Central Health. The duration of this offer is for 24 months from award of contract.
SUBSTITUTION OF MATERIALS (a)
Tenders shall be based upon using the materials or products as specified without substitution. Where two or more brand names are specified the choice shall be left to the contractor. Where only one brand name is stated there shall be no substitution. (b) Where the Specifications include the "or approved equal" clause, substitutions may be proposed provided that: 1. the request for a substitution is made in writing at least three (3) business days prior to the bid date; 2. the request shall clearly define and describe the product for which the substitution is requested; Re-Issued August 2006 3 - Instructions to Bidders - 4 3. the substituted article is equivalent to the specified article with regards to design, function, appearance, durability, operation and quality. Approval of the substitution by the Engineer/Architect shall be in the form of an addendum to the Specifications issued at least two (2) days prior to the Tender closing date to all of those contractors listed as having received a copy of the Contract Documents.
PART 2
PRODUCTS
2.1
GENERAL .1
All equipment supplied under this contract shall be made of the best grade materials and with first class workmanship and shall be in strict accord with the Drawings and Specifications.

PLUMBING COMPONENTS .1
All control valves and faucets, pipe fittings, waste and tail pieces etc., must be brass chrome plated, bright finish, new, best quality and comply with applicable codes.

Valve handles must be of non-conductive materials.

All welding shall conform to the requirements of CSA specifications and be performed by fabricators who are approved by the Canadian Welding Bureau and CSA specifications. Exposed welds shall be filed or ground smooth and flush and polished to match surfaces.

Electric seamless welding shall utilize low carbon filler rod, coated with non-carbonaceous flux, with sufficient chromium and nickel so that the deposited metal and the original metal have the same composition.

Welds shall be free from pits, cracks, discoloration and other imperfections.

Welded joints shall be butt fitted, properly jigged, continuous, ground smooth and polished for both exposed conditions as well as unexposed welds on underside of equipment.
WELDING
FABRICATION .1
Before fabrication commences, check all dimensions and conditions at the building site, including means of access into and through the building to the area where equipment is to be set in place, for all conditions affecting the delivery and installation of the equipment.

Fix and assemble work in the shop wherever possible. Execute the work in accordance with details and shop drawings which have been reviewed and accepted by the Consultant. Where complete or final shop fabrication is not possible, make a trial assembly in the shop prior to delivery.

Workmanship shall be of the best grade modern shop and field practice for the manufacturers who specialize in this work.

Fabricate and erect work square, plumb, straight and accurately fitted. Provide adequate reinforcing and anchorage in all places.

Insulate where necessary to prevent electrolysis.

All drillings to be reamed and exposed edges left clean and smooth.

Pop rivets shall not be used unless clearly noted on shop drawings, and then only if such drawings have been reviewed and accepted by the Consultant.

The methods of construction, reinforcement and anchorage, as well as details of finish, fitting and jointing and other data indicated on shop drawings shall be accurately followed. No deviations from shop drawings which have been reviewed and accepted will be permitted during the construction of equipment or installation.

The gauge of metal and methods of construction shall in all cases be adequate for the various conditions to be met, with the requirements of the design details and Specifications considered as minimum. Finished equipment shall be rigid when assembled and installed.

All fastenings and fittings shall be stainless steel, type 302 or 304 unless otherwise specified. All bolts and screws shall have truss heads or flat heads which are properly countersunk, at exterior and interior surfaces which are normally visible. Concealed fastenings shall be used throughout, unless otherwise approved by the Consultant.

Make provisions in the equipment for proper installation of services and connections. Cut and patch only when necessary. The completed installation shall be properly finished with-out rough edges or exposed openings.

Allow for expansion and contraction of materials.

STAND: All units to be supplied with a 610mm high 304 SS stand. Stand to be all welded construction and fabricated to be sturdy when be moved with Combi Oven fastened to it. Stand to be fabricated so that oven is fastened to it. Stand to be customized for the oven and include an undershelf. Stand to be mobile with heavy duty 100mm casters which are non-marking (polyurethane), have grease seals and can with stand high pressure washings; front casters to be complete with heavy duty breaks. Caster horn (body) to be SS or Poly urethane.

OPERATIONAL START UP AND TRAINING SUPPORT: A Manufacturer Certified Chef is to provide client training (first three units up to two (2) site visits for the first three (3) facilities installed and one (1) for each remaining site (4) to review general operation and customization of the Combi Oven’s features to the owner’s menu and production methods. Emphasis on preventive maintenance is to be included for all parties and included as a sign off requirement in the startup process.

MANUFACTURER AUTHORIZED INSTALLATION, START-UP AND CHECK PROGRAM: The installation of each Combi Oven will include the presence of a manufactured authorized service agent to do the technical start-up which will include; Check installation (CH approved Installation/Commissioning / Sign off checklist) Confirm unit operates in all modes Calibrate and Level unit Instruct user on preventive maintenance requirement & procedures Instruct user on basic operation of operating and cleaning modes (not cooking training) Supply a three (3) month supply of all materials required for the daily operation of the cleaning system. This service is to include all pre- site coordination requirements with the provision of planning documents for engineers and the facilities team including remote service support.

WARRANTY: All units are to include a full two (2) year version of the manufacturers standard warranty. Warranty scope is not reduced or modified due to CH staff knowledge of equipment repair and maintenance. If manufacturer proposes to include CH staff in warranty execution, a financial proposal for such a service is to be included in the submission for this RFP.

CH MAINTENANCE / FACILITIES COMBI OVEN MAINTENANCE AND SERVICE TRAINING – CASH ALLOWANCE: The manufacturer shall train CH Maintenance / Facilities representatives to have the necessary skills to service, update, diagnose and repair the ovens as supplied. A maximum of five (5) CH representatives will receive direct training from the manufacturers in house training team to be completely familiar with all aspects of maintaining the ovens for the ovens entire operational life cycle (estimate 15 years). The manufacturer / supplier is to include a cash allowance for the travel (airfare, ground transportation and accommodations only) of the CH representatives to the training facility of the manufacturer in their bid. Travel expenses are to calculate on provincial procurement standards (economy airfare, standard room hotel rates, shared full size vehicle or standard van) with a 25% additional allowance for peak travel time fare premiums. Supplier is to bill only the portion of cash allowance which is directly incurred on travel expenses (no additional markup). Training is to be completed and certified before the startup of the first oven delivered. Further training of CH Maintenance / Facilities representatives will take place at a CH Facility upon completion of starting up all seven units. The training is to be completed by the manufacturers service training employee at a site in Grand Falls. If further training is required within ten (10) years of the final oven being installed, CH will send their staff to the manufacturers training expense. Training by the manufacturer will be no cost to CH; all travel costs related will be the responsibility of CH.

SPARE PARTS CASH ALLOWANCE OPTION: All bidders proposals are to include a manufacturer recommended list of standard spare parts for CH to keep in inventory for quick access to repair the units as required. The Cost of this proposal is to be presented as a separate add on to the total proposed price as an option for CH to invest in.

EXECUTION SITE INSPECTIONS .1
All dimensions shown on the Drawings or listed in this Section of the Specification are to be considered nominal and for guidance only. It is the responsibility of the Foodservice Equipment / Refrigeration Contractor (FEC) to check dimensions on the site and to co ordinate any adjustments which may be necessary for the proper fabrication and set in place of the foodservice conveyor equipment.

If significant variances are apparent (in the opinion of the FEC) which may require changes affecting the intent or conditions of the contract, immediately notify the Consultant and do not proceed with that aspect of the work until the matter has been resolved.
.3
Fabricate equipment in sections that will allow easy access into the building and to final installation. Any damage to the building or the equipment will be this Contractor's responsibility.
.4
Verify all points of access into the job site and ensure that all pieces of equipment or fabricated items installed or relocated are able to pass through doors, hallways etc. in order to arrive at designated location on plans.
Water Quality .1
The supplier / installer of each oven is to obtain water quality information for each site here a Combi Oven is to be installed. The supplier / installer is to use the site water quality information to recommend that best water filtration for the installation of each oven.

The supplier is to obtain all information of existing water filter systems at each site and determine if what is on site can accommodate the water quality requirements of the oven. The suppliers / installers final recommendation is to include an evaluation of all existing water filter systems.

DELIVERY & STORAGE OF EQUIPMENT .1
Co ordinate deliveries of equipment in conjunction with construction activity and progress at the site and as dictated by the Owner. The successful bidder is to provide proposed delivery dates for the units identified for immediate delivery. Delivery dates for all other units are to be identified and finalized (final dates to be finalized with owner at the time of awarding this contract) . Delivery for the following projects are:

Deliver, unpack and set-in-place all equipment in the designated position, ready for final connection of services, for units with electrical or mechanical connections.

Supply to the Owner and General Contractor, in sufficient time, any information or items of service, articles, components or equipment which requires building in or which may overlap or impede the work of others.

Coordinate with owner the identification of all existing equipment including the confirmation of all services. Insure all equipment and materials for the installation or relocation of existing equipment as per this specification are present. Report any discrepancies.

All existing equipment (relocated) hook up requirements are to be included in contractor’s shop drawings.

INSTALLATION .1
Caulk and seal equipment to walls, base pads, curbs, and adjacent equipment where required.

Leave installed work neat, cleaned and polished, well fitted into position, level, and in proper operating condition.

Promptly remove all rubbish and debris from the building and site as the work proceeds and on completion.
.4
Activate, test and adjust all equipment and apparatus installed under this Contract. Refinish and repair any painted and finished surfaces damaged during erection and installation. Hand over the completed installation in first class condition and working order.
.5
Ensure electrical equipment is accompanied by label or certification of approval by Canadian Standards Association, Hydro Electrical Power Commission or Local Authority.
.6
Finished work must be perfectly true and plumb with no warping, buckling or open seams. All edges, hidden or exposed must be ground smooth and rounded. No rivet head, weld mark, or other imperfections acceptable.
.7
Cutting and repairs for the proper installation of services are part of the work in this Contract. Obtain permits or special inspections. No allowance will be made for costs incurred.

MAINTENANCE MANUALS .1
Supply three (3) sets of manuals for each site. Submissions to be bound and labeled, incorporating operating and maintenance instructions, including spare parts list and optional accessories for all items specified.

Identify each item, arrange in proper sequence, and ensure that the numbers correspond to the specifications and drawings.
.3
Provide an itemized lead sheet at the front of the manual with a list of the contents and the name and phone number of the service company.
DEMONSTRATION & WARRANTY .1
After completion of installation, cleaning, testing and final inspection, instruct the Owner Designee or his authorized personnel in the correct operation and maintenance of the equipment.
.2
A demonstration shall be made of each piece of equipment requested by the Consultant, and such demonstration shall be carried out by a representative of the manufacturer's equipment with a minimum of five years operating and servicing the unit.

It is the responsibility of the FEC to correct deficiencies and make adjustments to items which are not functioning properly at the time of demonstration.

The FEC shall co ordinate the schedule for equipment demonstrations with the Owner's representative, with adequate time allowed for each demonstration.

The Consultant will inspect equipment on substantial completion of work and will issue a deficiency report immediately thereafter.
.6
The Owner reserves the right to inspect equipment at the factory of the FEC, or at other locations as necessary.
.7
Rejection of any item of equipment, components or fabrication will be based on degree of conformance to the Specification and Drawings, and is subject to the Conditions of the contract in any matter of dispute.
.8
All new equipment shall be guaranteed for a minimum of two (2) year from the date of acceptance against defects in material, manufacture, assembly, labour and installation. Those items or components which have inherent guarantee periods beyond this minimum shall be sustained to the maximum time provided by the manufacturer.
.9
If defects become apparent during the guarantee period they shall be made good by the supplier or his authorized representative. The supplier is meant to be the manufacturer of the item, but under any circumstance it is the responsibility of the FEC to maintain the obligation of guarantee whether or not the supplier provides this service.
.10
The guarantee shall not apply where it can be clearly shown that a defect or malfunction is due to misuse or neglect by the Owner or his representative.
.11
The guarantee period shall commence upon acceptance of the equipment by the Owner (commissioning, training, technical start up complete, or such date(s) as may be mutually agreed upon after substantial completion of the work. In no event shall the period of guarantee begin later than the date upon which the lien holdback expires.
