500 Corporate Woods Parkway, Vernon Hills, IL 60061 • phone: 847.478.2100 An ISO9001 & ISO14001 Certified Company TERM: This Limited Warranty applies only to Clean Room Specified Robot Arm and Controller Product sold by and registered with Mitsubishi Electric Automation, Inc. (“MEAU”) after October 1, 2014 for installation and use solely in Mexico, Canada and the lower 48 states in the United States of America (the “Product”). MEAU warrants that the Product shall be free from defects in materials and workmanship under normal use and service for 36 months from the date of Product installation at the premises of the original end user or 42 months from the date of shipment from MEAU, whichever comes first ("Warranty Period"). If MEAU receives written notice of covered defects during the Warranty Period, MEAU shall, at its option, either replace or repair Product which proves to be defective, subject to the limitations and procedures described below. MEAU will cover the costs for parts and labor. Product must be returned to MEAU for repair and testing in MEAU's certified Clean Room. MEAU will cover the cost of ground shipment (to and from the customer's location). The use of other shipping methods is at the expense of the customer. The customer is responsible for packaging the Product to minimize the potential for shipping damage. Product not registered is not eligible for this Limited Warranty and will fall under the standard limited warranty terms that can be found at https://us.mitsubishielectric.com/fa/en/legal-notices Customers must follow the Claim Procedures below when notifying MEAU of any covered defect. OPTION TO PURCHASE: For Product purchased after April 1, 2014 but before October 1, 2014, MEAU offers customers an option to purchase the 36/42 month limited warranty for $600 per robot. The Warranty Period for such Product will remain the same, i.e. 36 months from the date of Product installation at the premises of the original end user or 42 months from the date of shipment from MEAU, whichever comes first. This option must be purchased within 90 days of October 1, 2014. Payment must be made in full at the time of purchase. To purchase this option, please fill out the registration form found at https://us.mitsubishielectric.com/fa/en/support/services/robot-registration and send it, along with a purchase order, to [email protected]. Failure to purchase this option will result in an original limited warranty period of 24 months from the date of Product installation at the premises of the original end user or 30 months from the date of shipment from MEAU. The original Limited Warranty covers parts and labor only; repairs will be conducted at MEAU’s facility in Vernon Hills, IL or such other location as selected by MEAU. The customer is responsible for shipment of the covered equipment to MEAU’s facility. Product which MEAU determines in its sole opinion, to be covered under this Limited Warranty will be returned to customer by one way ground shipment prepaid. See below for how to file a claim. LIMITATIONS: This Limited Warranty does not apply to Products whose serial numbers have been altered, defaced or removed, nor to Products which have been subject to damage during shipment. This Limited Warranty does not cover failure of equipment not supplied by MEAU (including components or software), nor does it cover failure of or damage to Product due to misuse (including use in other than normal customary manner), neglect, accident, improper installation, or repair, alteration or modification not performed by MEAU personnel, excessive physical or electrical stress, or operation under abnormal or improper environmental conditions or the like. Since the machine or system on which the Product is to operate is provided by third parties, MEAU is not responsible for the operation, availability or loss of use of the machine or system. In addition, this Limited Warranty does not cover normal preventive maintenance items such as filter replacement, cleaning of the Product or problems caused by lack of preventative maintenance, improper cleaning, improper programming or improper operating procedures. During the Warranty Period, Products determined by MEAU, in its sole opinion, to be defective shall, at MEAU’s option, either be repaired at a location authorized by MEAU and returned free of labor, parts and shipping charges or replaced with an equivalent Product. Defective Products replaced by MEAU shall become the property of MEAU. Customer understands that repairs may include replacement of Product, parts or components thereof with functionally equivalent reconditioned Product, parts or components. MEAU reserves the right to make any or all Product changes it may deem necessary without prior notice to Customer. This Limited Warranty does not include on-site repair of Product. THE FOREGOING SETS FORTH THE EXCLUSIVE REMEDY OF CUSTOMER AND THE SOLE LIABILITY OF MEAU FOR ANY AND ALL CLAIMS BASED ON FAILURE OR DEFECTS IN PRODUCTS COVERED UNDER THIS LIMITED WARRANTY, 500 Corporate Woods Parkway, Vernon Hills, IL 60061 • phone: 847.478.2100 An ISO9001 & ISO14001 Certified Company WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE AND IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES WHETHER WRITTEN OR ORAL, IMPLIED OR STATUTORY. THE FOREGOING WARRANTY DOES NOT APPLY TO ANY PRODUCT OR SERVICE PROVIDED BY THIRD PARTIES. EXCEPT AS EXPRESSLY STATED IN THIS LIMITED WARRANTY, MEAU MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE PARTS OR SERVICES COVERED BY THIS LIMITED WARRANTY. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY EXCLUDED. IN NO EVENT, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL MEAU BE LIABLE TO CUSTOMER OR ANY THIRD PARTIES FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE OR FOR ANY CAUSE WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE OF PRODUCT, LOST PRODUCTION, LOSS OF BUSINESS, COST OF SUBSTITUTE EQUIPMENT, OR FACILITIES OR SERVICE DOWN TIME. MEAU reserves the right to return any Product received without an authorized RMA number to the customer freight collect. No credit or other reimbursement shall be issued for any repair performed by distributors and service centers, other than as specifically authorized by MEAU in writing. MODIFICATIONS: The procedures described in this Limited Warranty may be modified from time to time by MEAU without prior notice. No waiver or alteration of any of the provisions of this Limited Warranty and claim procedures shall be binding upon MEAU, unless made in writing and signed by a duly authorized officer of MEAU.
