Congratulations on your purchase of the HP Server Appliance. You have purchased an exceptional product that comes with exceptional support services. This booklet shows you how to obtain service if you have a problem, and also shows you how to find more information on optimizing the performance of your HP Server Appliance. HP’s warranty terms and conditions are located at the end of this booklet. Your Hewlett-Packard Limited Warranty One-year next day unit replacement warranty HP warrants to you, the end user customer, that HP hardware, accessories, and supplies will be free from defects in materials and workmanship for a period of ONE (1) YEAR. If HP receives notice of such defects during the warranty period, HP will replace the unit that proves to be defective by the end of the next business day provided that customers notify HP or Resellers by 3pm local time. Replacement units may be either new or equivalent in performance to new. Replacement units assume the remaining warranty of the units they replace. The replaced units become the property of HP and must be returned to HP after the replacement has been installed. The replacement units become your property. 1. HP does not warrant that the operation of HP products will be uninterrupted or error free. 2. HP products may contain remanufactured parts equivalent to new in performance or may have been subject to incidental use. 3. Warranty does not apply to defects resulting from, a. improper or inadequate maintenance or calibration, b. software, interfacing, parts or supplies not supplied by HP, c. unauthorized modification or misuse, d. operation outside of the published environmental specifications for the product, or e. improper site preparation or maintenance. HP Software Warranty HP warrants for ONE (1) YEAR from the date of purchase that all HP pre-installed software will execute its programming instructions when all files are properly installed. During the one-year warranty period, in the event that software fails to execute its programming instructions, HP will provide customers with remote assistance (by phone and/or by email) for installation and configuration. HP warrants all the software media that comes with your server appliance for NINETY (90) DAYS from the date of purchase. During the 90-day warranty period, if the software fails to install and/or configure your server appliance due to the software media, customer's remedy will be either (1) a replacement, or (2) a refund of the purchase price (license fee) if HP is unable to replace the media within 10 business days upon return of the product and all copies of software as well as installation instructions. For telephone support, contact your authorized reseller. For how many years can I receive free phone support on my Server Appliance? You can receive free phone support for the warranty period of your HP Server Appliance product. HP supports all Server Appliances for a full three years after the product’s obsolescence date. When does my warranty coverage start? The warranty period officially begins on the day that HP delivers your HP Server Appliance. How can I upgrade my HP Server Appliance warranty? HP Supportpack – provides enhanced service such as faster response time or around-the-clock support. Please contact HP or your local Resellers for more information. What should I have ready before I call for service? Before you call, have this information ready: • • • • • • Product model name and number Product serial number Applicable error messages from system or diagnostics Applicable hardware driver revision levels Add-on boards or hardware installed Third-party hardware or software What should I expect when I call for service? Service calls follow this process: 1. The call agent will ask questions and may ask you to run HP-supplied configuration and diagnostic programs, and will attempt to resolve the problem over the phone. 2. If the problem cannot be resolved over the phone, HP will dispatch a replacement unit to your site. Can I accidentally void my Server Appliance warranty? You can accidentally void your Server Appliance warranty. HP warranty covers problems caused by HP factory integrated third-party products that are internal but not external to your HP Server Appliance. HP reserves the right to charge for services where the cause of the error is found to be a non-certified third-party product. In addition, HP reserves the right to charge for resolving problems caused by untrained non-HP personnel who have serviced your computer equipment. What happens to defective parts, if any, that are removed from my Server Appliance? When parts are exchanged, if any, during a repair, the removed parts become the property of HP. When you receive a replacement part, you must return the removed part to HP within 10 business days. You will be charged for any part not returned within that time period. What is the warranty on software installed on my Server Appliance? HP warrants its software or HP factory-provided third-party software for a period of 1 year. During that period, HP will provide customers with remote assistance (by phone and/or by email) for installation and configuration and/or replace defective software via the exchange process. HP does not warrant customer-installed thirdparty software. HP assumes no responsibility for the use or reliability of HP software on equipment that is not furnished by HP. What is not covered by this warranty? Your HP Server Appliance warranty does not cover the following: • Products purchased from anyone other than HP or an authorized HP reseller • Non-HP products installed by unauthorized entities • Consumables, such as batteries • Customer-installed third-party software • Routine cleaning, or normal cosmetic and mechanical wear • Damage caused by misuse, abuse, or neglect • Damage caused by parts that were not manufactured or sold by HP • Damage caused when warranted parts were repaired or replaced by an organization other than HP or by a service provider not authorized by HP Is my warranty still valid if I ship my HP Server Appliance into or out of the country? Your HP Server Appliance will receive the standard warranty in the country of purchase. If you move your Server Appliance to another country where HP has established legal subsidiaries or International Distributors, you will receive the destination country standard warranty. Warranty coverage is provided in the destination country if the product has been marketed by HP in that country and may be subject to local government restrictions. Notice for Consumers in Australia The warranty terms contained in the enclosed manual(s) or any other warranty statement enclosed with this product, except to the extent lawfully permitted, do not exclude, restrict, or modify, and are in addition to, statutory rights implied by the Trade Practices Act 1974 or any corresponding state or territory legislation applicable to the sale of this product to you. If HP or Authorized Reseller receives notice of such defects during the warranty period, HP or Authorized Reseller will, at its option, either repair or replace products that prove to be defective. Replacement parts/units may be new or equivalent in performance to new. Should HP or Authorized Reseller be unable to repair or replace the hardware or accessory within 10 business days, Customer's alternate remedy will be a refund of the purchase price upon return of the Server Appliance. Hewlett-Packard Hardware Accessories Limited Warranty An HP Server Appliance Hardware Accessory is an HP hardware product, specifically designated for use with HP Server Appliances, that is added on or integrated into an HP Server Appliance in order to provide higher performance, capacity, or increased capability. Upon installation inside an HP Server Appliance, the HP Server Appliance Hardware Accessory carries a one-year Return-to-HP warranty or the remainder of the warranty period for the original HP Server Appliance in which it is installed, whichever is longer. Notice of Warranty Claims. All warranty claims must be made during the applicable warranty period. Any claim made after that time will not be eligible for warranty service but may be serviced under a separate HP support contract covering the product. Limitation of Warranty HP does not warrant uninterrupted or error-free operation of an HP Server Appliance. This warranty is transferable and honored in any country where HP has established legal subsidiaries or International Distributors. If a customer transfers a product to another user, warranty service is available to that user for the remainder of the warranty period. Consumables, such as batteries, have no warranty. The above warranties will not apply to products from which serial numbers have been removed or to defects resulting from misuse (including operation of HP Server Appliance without covers and incorrect input voltage), unauthorized modification, operation or storage outside the environmental specifications for the product, in-transit damage, improper maintenance, or defects resulting from use of third-party software, accessories, media, supplies, consumables, or such items not designed for use with the product. The HP Software Product Limited Replacement Warranty does not apply to software used with products not covered by any of the HP limited warranties offered as part of your purchase of an HP Server Appliance product. TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTIES ARE EXCLUSIVE AND NO OTHER WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND HP SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE. Some Countries, states or provinces do not allow limitations on the duration of an implied warranty, so the above limitation or exclusion might not apply to you. The warranty gives you specific legal rights and you might also have other rights that vary from country to country, state to state or province to province. Limitation of liability and Remedies. In no event will HP or its affiliates, subcontractors, or suppliers be liable for any of the following: 1. Damages for loss of data, or software restoration; 2. Damages relating to Customer's procurement of substitute products or services (i.e., “cost of cover”); 3. Incidental, special, or consequential damages (including lost profits, loss of use, Customer downtime, cost of data recovery/re-creation), even if HP is informed of their possibility; 4. Third-party claims against Customer for losses or damages. HP Server Appliances are not specifically designed, manufactured or intended for sale as parts, components or assemblies for the planning, construction, maintenance, or direct operation of a nuclear facility. Customer is solely liable if Products or Support purchased by Customer are used for these applications. HP will be liable for damage to tangible property per incident up to the greater of $300,000 or the actual amount paid for the product that is the subject of the claim, and for damages for bodily injury or death, to the extent that all such damages are determined by a court of competent jurisdiction to have been directly caused by a defective HP product. TO THE EXTENT ALLOWED BY LOCAL LAW, THE REMEDIES IN THIS WARRANTY STATEMENT ARE CUSTOMER'S SOLE AND EXCLUSIVE REMEDIES. EXCEPT AS INDICATED ABOVE, IN NO EVENT WILL HP OR ITS SUPPLIERS BE LIABLE FOR LOSS OF DATA OR FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT OR DATA), OR OTHER DAMAGE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE. Some countries, states or provinces do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. THE WARRANTY TERMS CONTAINED HERE, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT OR MODIFY AND ARE IN ADDITION TO THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THIS PRODUCT TO YOU.
